中药标准化策略与商业秘密保护制度的协调研究

【摘要】：目的:为中药标准化战略与知识产权战略的有效融合提供参考。方法:通过分析中药的标准化要求与知识产权制度的冲突,寻求中药标准与知识产权特别是商业秘密权之间的协调策略。结果:中药标准的公开化要求与中药知识产权特别是中药商业秘密的保护要求之间面临着制度设计上的对立和冲突。解决冲突的关键,一是需要在公法领域明确政府在标准化战略实施过程中的角色与定位;二是需要在私法领域确立信息披露与信息保密的协调原则,实现信息的差异公开和适度公开。结论:中药标准化不是绝对的,在处理信息自由与秘密信息的保护问题上,利弊权衡是处理中药标准化策略与商业秘密制度之间冲突的前提。
[Abstract]:Objective: to provide a reference for the effective integration of standardization strategy and intellectual property strategy of traditional Chinese medicine. Methods: by analyzing the conflict between the standardization requirement of Chinese medicine and the intellectual property system, the coordination strategy between the standard of traditional Chinese medicine and intellectual property rights, especially the right to trade secrets, was sought. Results: the open requirement of Chinese medicine standard and the protection requirement of intellectual property right of traditional Chinese medicine, especially the protection of trade secret of traditional Chinese medicine, are confronted with the contradiction and conflict in system design. The key to resolving conflicts is to clarify the role and orientation of the government in the field of public law in the implementation of standardized strategy, and to establish the coordination principle of information disclosure and information confidentiality in the field of private law. Realize the difference of the information open and moderately open. Conclusion: the standardization of traditional Chinese medicine is not absolute. In dealing with the problem of information freedom and the protection of secret information, the trade-off between advantages and disadvantages is the premise of dealing with the conflict between the standardization strategy of traditional Chinese medicine and the trade secret system.
