我国儿童福利法律制度的完善

【摘要】：我国儿童福利正处于补缺型儿童福利制度向适度普惠型儿童福利制度转型的初期,在此期间,我国需要运用法律来保障儿童的福利,让儿童的权利得到保护,让全体儿童的合法权益不受到侵犯,使得儿童能够更健康快乐地成长。儿童福利法律制度是关于儿童福利的法律规范的总称,是为了确保儿童权利的实现,利用法律法规在儿童权利的确认与保护的基础上,增加儿童福祉的一系列制度。经过对我国的儿童福利法律制度的现状分析,我国目前存在儿童福利立法层次偏低、儿童福利法律制度零散,缺少统一法律规范,儿童福利法律法规缺少可操作性等问题。本文就此提出相关建议:在儿童社会福利的法律制度上,树立适度普惠型儿童福利理念,加快制定一部《儿童福利法》,健全我国具体儿童福利法律制度,全面保障儿童权益,使儿童享受相应的福利待遇,保证我国全体儿童的各方面合法权益不受侵犯,使得全体儿童都拥有快乐的童年。
[Abstract]:China's child welfare is in the early stage of the transition from a complementary child welfare system to a moderately inclusive child welfare system. During this period, our country needs to use the law to safeguard the welfare of children and protect their rights. So that all children's legitimate rights and interests are not violated, so that children can grow up healthier and happier. The legal system of child welfare is the general name of the legal norms on the welfare of children. It is to ensure the realization of children's rights and to use laws and regulations to increase the well-being of children on the basis of the recognition and protection of children's rights. Through the analysis of the current situation of the child welfare legal system in our country, there are some problems in our country, such as the low level of the child welfare legislation, the scattered legal system of the child welfare, the lack of unified laws and regulations, the lack of maneuverability of the laws and regulations of the child welfare, etc. In this paper, some suggestions are put forward: in the legal system of children's social welfare, we should establish the concept of moderately inclusive child welfare, speed up the formulation of a Child Welfare Law, perfect the specific legal system of children's welfare in our country, and protect children's rights and interests in an all-round way. To make children enjoy the corresponding welfare treatment, to ensure that all the legitimate rights and interests of all children in our country are not infringed, so that all children have a happy childhood.
