【摘要】：土地征用问题是目前中国转型时期中最重要的问题，过去十几年，围绕土地征用问题产生的种种利益纠纷事件，政府在其中担任了重要角色。近来，政府在土地征用中的失范，引发了大量的群体性事件和上访事件，其中以血抗争、以力抗争的恶性事件持续不断，造成了群众对政府的信任危机。由于各个城市发展的状况不同，在土地征用过程中遇到的问题也不同。如果不能够有效的规划、合理的征地，风险将得不到有效的治理，那么在土地征用过程中遭遇的风险有可能会转变成危机事件。因此，政府加强风险治理显得格外重要，构建完善的政府风险治理机制有其现实的意义。本选题的目标方向依赖于把风险治理的理念与政府的土地征用过程相结合，用风险治理理论、风险治理方法和风险治理机制从源头上预防和避免危机事件的发生，促进政府在土地征用过程中的和谐有序发展。本文共分为五个章节：第一章节是导论，主要介绍了本文探讨的社会背景和研究目的。综合阐述了土地征用过程中遭遇的风险问题，并通过风险治理的研究视角作为切入点。第二章节重点描述了在土地征用过程中产生的政府风险，即风险的含义、类别和产生这些风险的原因。第三章节为土地征用中的风险治理概念的内涵界定。本章节将引入最新的社会风险管理的理论，与我国有特色的土地征用问题相结合，勾划我国政府风险治理概念的大概轮廓。最后对风险治理应用到土地征用中的必要性进行分析。第四章节为土地征用中的风险治理困境分析。风险治理意识的缺失、风险治理中政府角色的错位、风险治理制度的丧失及风险治理运行机制的滞后等是最主要的问题。第五章节与前文相呼应，，从宏观的角度谈构建风险防范机制的基本构想。建立听证制度、加强法律风险治理、引进风险治理报告制度等是其中重点讨论的问题。
[Abstract]:Land expropriation is the most important issue in the period of China's transformation. In the past ten years, the government has played an important role in all kinds of interest disputes arising from the land expropriation. Recently, the anomie of the government in the land expropriation has caused a large number of mass incidents and petition incidents, among which the vicious incidents of fighting with blood and fighting with strength have continued, resulting in a crisis of trust in the government by the masses. Due to the different development of each city, the problems encountered in the process of land expropriation are also different. If there is no effective planning, reasonable land acquisition, the risk will not be effectively managed, then the risk encountered in the process of land expropriation may be transformed into a crisis event. Therefore, it is very important for the government to strengthen risk management, and it is of practical significance to construct a perfect government risk management mechanism. The objective direction of this topic depends on combining the concept of risk management with the process of land expropriation of the government, using the theory of risk management, the method of risk management and the mechanism of risk management to prevent and avoid the occurrence of crisis events from the source. To promote the harmonious and orderly development of the government in the process of land expropriation. This paper is divided into five chapters: The first chapter is an introduction, mainly introduces the social background and research purpose of this paper. This paper comprehensively expounds the risk problems encountered in the process of land expropriation, and takes risk governance as the starting point. The second chapter mainly describes the government risks in the process of land expropriation, that is, the meaning, types and causes of these risks. The third chapter defines the concept of risk management in land expropriation. This chapter will introduce the latest theory of social risk management, combine with the characteristic land expropriation problem in our country, and outline the outline of the concept of risk management of our government. Finally, the necessity of applying risk management to land expropriation is analyzed. The fourth chapter is the land expropriation risk management dilemma analysis. The main problems are the lack of risk management consciousness, the dislocation of government role in risk management, the loss of risk management system and the lag of risk management operation mechanism. The fifth chapter echoes with the previous text, and discusses the basic conception of constructing the risk prevention mechanism from the macro point of view. Establishing hearing system, strengthening legal risk management and introducing risk management report system are the key issues to be discussed.
