辽宁省机动车交通事故社会救助基金补偿程序问题研究

【摘要】:机动车交通事故社会救助基金是国家设立的,用于抢救在机动车交通事故的交通事故受害人而先行垫付的资金,是一项重要的社会救助制度,已在一些国家或地区开始实施。作为社会救助的一种新形式,机动车交通事故社会救助基金制度的设立,对保障机动车交通事故受害人权益、分担交通事故风险、促进社会和谐起到了积极的推动作用。然而,令人遗憾的是机动车交通事故社会救助基金制度在我国还没有广泛施行,有待于进一步的普及与提高。我国第一次提出机动车交通事故救助基金制度的概念,是《中华人民共和国道路交通安全法》(以下简称《道路交通安全法》)颁布实施,从该概念的确立到现在已将近11年,然而实践的情况是除少数省、市已有部分机动车交通事故交通事故受害人获得救助基金救济外,包括北京市、辽宁省在内的大多数地区,基金救助工作尚未完全展开。我所在的辽宁省虽然在各方面的努力之下,,于2014年启动了机动车交通事故救助基金,但在机动车交通事故社会救助基金救助程序方面的现实操作中缺管明确具体的规定,导致一方面大多数的救助基金剩余,另一方面相当数量的机动车交通事故当事人无法得到有效救助,二者出现矛盾,导致大多数救助基金仍然在“沉睡”中,远未发挥其应有之功用。目前,我所在的辽宁省法库县人民法院至今未受理一起关于机动车交通事故社会救助基金的诉讼,当地至今也未设立救助基金管理部门。造成这个现象的重要原因是,法律对救助基金补偿程序的规定过于原则而缺乏可操作性。现行规定对补偿程序的启动主体、审核主体没有明确的具体规定,特别是管理机构审核程序,交通事故受害人与基金管理机构发生争议的解决机制,交通事故受害人的救助途径、对救助基金管理机构及基金管理人的监督等方面的规定过于笼统,致使救助基金补偿程序在现实操作中存在诸多问题。这便制约了救助基金制度充分发挥应有之功能,无法有效保护交通事故交通事故受害人的利益。本文拟从辽宁省机动车交通事故社会救助基金制度的实施现状出发,借鉴各省市在补偿程序方面的规定,参考其他国家和地区的先进经验,以此为基础,提出完善辽宁省道路机动车交通事故社会救助基金补偿程序的整体思路,探索出救助基金制度的相关措施和意见,以便能引起业界同仁的关注,并促成该补偿程序的付诸实施,发挥机动车交通事故社会救助基金应有之功用。
[Abstract]:The motor vehicle traffic accident social assistance fund is established by the state, which is used to rescue the traffic accident victims in the motor vehicle traffic accident and advance the funds, is an important social assistance system, has been implemented in some countries or regions. As a new form of social assistance, the establishment of social assistance fund system for motor vehicle traffic accidents has played a positive role in protecting the rights and interests of the victims of motor vehicle traffic accidents, sharing the risks of traffic accidents and promoting social harmony. However, it is regrettable that the social assistance fund system for motor vehicle traffic accidents has not been widely implemented in China, and needs to be further popularized and improved. The concept of the motor vehicle traffic accident relief fund system was first put forward in China, which was promulgated and implemented by the Road Traffic Safety Law of the people's Republic of China (hereinafter referred to as the Road Traffic Safety Law). It has been nearly 11 years since the concept was established. However, in practice, except for a few provinces and cities, some of the victims of motor vehicle traffic accidents have received relief from the relief fund. In most areas, including Beijing and Liaoning Province, the relief work of the fund has not been carried out completely. Although Liaoning Province, where I live, started the motor vehicle traffic accident rescue fund in 2014, it lacks clear and specific regulations in the practical operation of the social assistance fund for motor vehicle traffic accidents. On the one hand, most of the rescue funds are surplus; on the other hand, a considerable number of the parties involved in motor vehicle traffic accidents are unable to get effective relief, and there are contradictions between the two, leading to the majority of the rescue funds still "sleeping". Far from performing its proper function. At present, the people's Court of Faku County in Liaoning Province has not accepted a lawsuit concerning the social relief fund for motor vehicle traffic accidents, and the local government has not set up a rescue fund management department. The main reason for this phenomenon is that the legal provisions on the salvage fund compensation procedure are too principled and lack of maneuverability. The current regulations have no specific provisions on the subject of the initiation of the compensation procedure, the subject of the audit, especially the audit procedure of the management body, the mechanism for resolving disputes between the victims of traffic accidents and the fund management organization, The relief ways for the victims of traffic accidents and the supervision of the fund management agencies and fund managers are too general, resulting in many problems in the practical operation of the relief fund compensation procedure. This restricts the rescue fund system to give full play to its proper function and can not effectively protect the interests of traffic accident victims. This paper intends to proceed from the present situation of the implementation of the social relief fund system for motor vehicle traffic accidents in Liaoning Province, draw lessons from the provisions of the compensation procedures of provinces and cities, and refer to the advanced experiences of other countries and regions, and take this as the basis. This paper puts forward the whole idea of perfecting the compensation procedure of the social relief fund for road motor vehicle traffic accident in Liaoning Province, and explores the relevant measures and opinions of the rescue fund system, so as to arouse the attention of the industry colleagues, and to promote the implementation of the compensation procedure. Give full play to the functions of the social assistance fund for motor vehicle traffic accidents.
