论卖淫嫖娼违法信息的披露

【摘要】：近些年,媒体中经常可见公安机关查禁卖淫嫖娼活动的现场报道及公众人物因卖淫嫖娼被处罚的报道。关于这种报道是否合法、是否合理,存在着不小的争议。文章首先从几个典型的案例引入,探讨公安机关以传统媒体或自媒体为媒介,将涉及个人信息的卖淫嫖娼违法信息向社会披露的行为的性质,得出其不合法、不合理且缺乏必要性的结论。接下来从我国法制传统及公安机关、媒体的管理和运行现状等方面进行分析,探究公安机关及媒体将该种信息向社会进行披露的原因。最后,尝试提出一种切实可行的制度架构,通过对披露范围和披露程序的严格限制,以期达到保护卖淫嫖娼违法者合法权益的目的。
[Abstract]:In recent years, the public security organs often see the suppression of prostitution reports and public figures for prostitution punishment reports. There is a great deal of controversy about whether such reports are legal and reasonable. First of all, from several typical cases, the article discusses the nature of the public security organ's behavior of disclosing the illegal information of prostitution and whoring involving personal information to the society by using the traditional media or the self-media as the media, and draws its conclusion that it is illegal. A conclusion that is unreasonable and lacks necessity. Then from the aspects of the legal tradition of our country and the public security organs, the management and operation of the media, this paper analyzes the reasons why the public security organs and the media disclose this kind of information to the society. Finally, a practical institutional framework is proposed to protect the legitimate rights and interests of prostitutes by strictly limiting the scope of disclosure and disclosure procedures.
