河南省道路交通事故社会救助基金管理立法问题研究

【摘要】：道路交通事故社会救助基金制度建立的初衷是为了保障道路交通事故中的受害人能够获得社会的补充救助。但《中华人民共和国道路交通安全法》仅提出设立道路交通事故救助基金,规定具体办法由国务院规定,未明确具体实施办法,交通事故社会救助基金制度未真正建立。至2009年财政部等五部委发布实施《道路交通事故社会救助基金管理试行办法》,对交通事故社会救助基金制度等内容作出了明确的具体规定,各地陆续开展此项工作。但近几年全国各地不同程度地暴露出道路交通事故社会救助基金制度不完善、运作困难、程序繁琐、资金大量冗余、追偿难、管理机构法律地位不明确等问题。本文通过结合河南省救助基金管理制度发展和实际运行中取得的成绩和面临的困难,比较全国各地开展此项工作的经验与不足,试图在立法层面分析道救助基金管理制度存在的问题,提出完善救助基金制度立法的建议。文章正文共分六部分:第一部分,关于道路交通事故救助基金相关的案例阐述,提出案例引发的焦点问题。第二部分,关于道路交通事故社会救助基金制度的一般理论。阐释了其概念、特征、性质、必要性以及价值。第三部分,关于当前河南省道路交通事故社会救助基金制度的立法、管理现状和实际效果。第四部分,关于当前河南省道路交通事故社会救助基金制度面临的问题,包括了基础规定层面、资金来源层面、管理运行层面和追偿层面。第五部分,关于国内道路交通事故社会救助基金制度立法及借鉴。对全国各省市道路交通事故社会救助进行分类对比,比较其实际效果、管理运行方式、垫付流程、垫付限额、一次性困难救助等方面,归纳可借鉴之处。第六部分,关于道路交通事故社会救助基金制度的完善建议和对策。主要是在借鉴外地和结合本地实际的基础上,针对河南省道路交通事故社会救助基金的立法问题提出立法改善对策。
[Abstract]:The original intention of the social relief fund system for road traffic accidents is to ensure that the victims of road traffic accidents can get supplementary social assistance. However, the Law of the people's Republic of China on Road Traffic Safety only proposes the establishment of the Road Traffic accident Relief Fund, which stipulates that the specific measures shall be formulated by the State Council, but the specific implementation measures are not clear, and the social relief fund system for traffic accidents has not really been established. By 2009, five ministries and commissions, such as the Ministry of Finance, have issued and implemented the trial measures for the Administration of Social Relief Fund for Road Traffic Accidents, which has made clear and specific provisions on the contents of the social relief fund system for traffic accidents, and the work has been carried out one after another in various localities. However, in recent years, the social relief fund system for road traffic accidents has been exposed to various degrees in China, such as imperfect system, difficult operation, cumbersome procedure, large amount of redundancy of funds, difficulty in recovering compensation, unclear legal status of management organizations, and so on. By combining the achievements and difficulties in the development and practical operation of the relief fund management system in Henan Province, this paper compares the experiences and shortcomings of the work carried out in various parts of the country. This paper tries to analyze the problems existing in the administrative system of the relief fund in the legislative level, and puts forward some suggestions for perfecting the legislation of the relief fund system. The text of this paper is divided into six parts: the first part, about the case of the road traffic accident rescue fund, put forward the focus problem caused by the case. The second part, about the road traffic accident social rescue fund system general theory. It explains its concept, characteristics, nature, necessity and value. The third part is about the legislation, management status and actual effect of social relief fund system of road traffic accident in Henan Province. The fourth part is about the problems faced by the social relief fund system of road traffic accident in Henan province, including the basic regulation level, the fund source level, the management operation level and the recovery level. The fifth part, about the domestic road traffic accident social relief fund system legislation and uses for reference. This paper compares and classifies the social assistance of road traffic accidents in various provinces and cities of China, compares its actual effect, management operation mode, advance payment flow, advance payment quota, one-off difficult relief and so on, and sums up the points for reference. The sixth part, about the road traffic accident social rescue fund system consummates the suggestion and the countermeasure. On the basis of drawing lessons from other countries and combining with the local reality, the legislative improvement measures of the social relief fund for road traffic accidents in Henan Province are put forward.
