【摘要】：本文主要分五部分展开阐述,第一部分是绪论部分,主要概括了本课题研究的目的、意义以及相关研究现状,为全文研究做好铺垫。第二部分主要对交通执法自由裁量权进行理论分析,涵盖交通执法自由裁量权的涵义及分类、行使原则等多个方面。第三部分,对交通执法自由裁量权行使的现状进行论述,综述我国交通执法自由裁量权失范的表现,找出交通执法自由裁量权失范的原因,验证规范交通执法行政自由裁量权必要性。第四部分,通过回顾分析英美法系国家、大陆法系国家对交通行政自由裁量权的经验,汲取国外交通执法自由裁量权先进经验,以推动我国交通执法自由裁量权的改进。第五部分,在以上基础上提出交通执法自由裁量权的规制措施,包括立法上制定交通执法自由裁量标准,加强交通执法自由裁量权的程序控制,建立完善的交通执法监督机制等内容。
[Abstract]:This paper is mainly divided into five parts, the first part is the introduction part, which summarizes the purpose, significance and related research status of this research, and makes a good foundation for the full text research. The second part mainly carries on the theory analysis to the traffic law enforcement discretion, including the traffic law enforcement discretion the meaning and the classification, the exercise principle and so on many aspects. The third part, discusses the present situation of the traffic law enforcement discretion, summarizes the performance of the traffic law enforcement discretion, finds out the reasons of the traffic law enforcement discretion. To verify the necessity of standardizing the administrative discretion of traffic law enforcement. The fourth part, through reviewing and analyzing the experience of the countries of Anglo-American law system and civil law system on the traffic administrative discretion, drawing on the advanced experience of foreign traffic law enforcement discretion, in order to promote the improvement of the traffic law enforcement discretion in our country. The fifth part, on the basis of the above, put forward the regulation measures of traffic law enforcement discretion, including legislation to formulate the traffic law enforcement discretion standards, strengthen the traffic law enforcement discretion procedural control. Establish perfect traffic law enforcement supervision mechanism and so on.
