上海市私车额度拍卖的合法性

【摘要】：上海市私车额度拍卖实施至今备受质疑,公众对其合法性的接受度不高,部分学者认为其增加了机动车登记的前置许可,违反了《行政许可法》和《道路交通安全法》,学者的论断会加剧其合法性可接受度的衰减。本文从上海市私车额度拍卖的法律性质入手,澄清私车额度拍卖是什么;然后讨论了上海市政府的权限,回答了政府为什么选择私车额度拍卖;接下来,本文对其争议进行反思,探讨了公众对其合法性接受度低的原因;最后,本文提出四条建议,以期提高公众对上海市私车额度拍卖的可接受度。上海市私车额度拍卖的合法性争议对中国法治进程和公众法律信仰的培养是莫大的伤害。争议本身并无问题,最大的问题是争议二十余年却仍无定论,对法学理论研究来说这个时间很短,对于法律实践来说,这时间几乎可以制定一部成文法。尽早解决其争议,结束上海市私车额度拍卖合法性的不确定状态,是本文的最终目的。
[Abstract]:Since the implementation of the private car quota auction in Shanghai has been questioned, the public's acceptance of its legitimacy is not high, and some scholars believe that it has increased the pre-licensing of motor vehicle registration. In violation of the Administrative Licensing Law and the Road Traffic Safety Law, the scholars' judgment will aggravate the attenuation of the acceptability of their legitimacy. Starting with the legal nature of the private car quota auction in Shanghai, this paper clarifies what the private car quota auction is; then discusses the authority of the Shanghai Municipal Government and answers why the government chose the private car quota auction. This paper reflects on the controversy and discusses the reasons for the low acceptance of its legitimacy by the public. Finally, this paper puts forward four suggestions in order to improve the acceptability of private car auction in Shanghai. The dispute over the legality of private car auction in Shanghai is a great harm to the process of rule of law and the cultivation of public legal belief. There is no problem in the dispute itself. The biggest problem is that the dispute is still inconclusive for more than twenty years. For the study of legal theory, this time is very short, and for legal practice, it is almost possible to make a statutory law. It is the ultimate goal of this paper to resolve the dispute as soon as possible and end the uncertainty of the legality of private car auction in Shanghai.
