家庭教育权及其保障问题研究

【摘要】：十年树木,百年树人。教育对于一个国家来说是一项具有战略意义的工作,教育不仅是提升国民素质的重要途径,也是增强国家综合实力的重要环节。随着市场经济的进一步发展,人们对多元化的教育形式以及教育质量优质化要求的呼声越来越高。而且在近几年的“两会”上,一些代表提出要对家庭教育权专门立法予以保护;同时一些代表也从解决“天价学区房”问题的角度上提议要重视家庭教育,这些提案使家庭教育权开始走进公众视野。然而,父母是孩子的第一任老师,家庭也是孩子成长的天然港湾,家庭教育的对一个孩子身心健康发展的重要性不言而喻,但是在立法层面上,法律中没有明确的条文保障家庭教育权,以致家庭教育成为学校教育的“附庸品”。在理论层面上,国内学者对家庭教育的研究集中于国家、学校教育以及家庭教育的具体方法上,对家庭教育权的研究讨论较为匮乏;在实践层面上,家长对家庭教育权缺乏关注和了解。因此,完善家庭教育权保障具有提升教育和推进法治进程的双重意义。在家庭教育法尚未出台之前,本文通过从家庭教育权利保障中存在的问题入手,分析其保障中存在的困境,在立足于我国国情的基础上,综合借鉴域外家庭教育立法中的一些经验做法,针对在家庭教育权利保障的过程中遇到问题提供一些解决对策。全文共分为五个章节。第一章节是绪论部分,包括研究的主要背景和研究意义。第二章节是关于家庭教育权的概述,主要从家庭教育、家庭教育权的含义和内容方面进行阐述,同时也对与家庭教育权有关的权利进行辨析。第三章节是论述家庭教育权的理论依据,包括论述权利来源之亲权和家庭教育权的权利证成。第四章节是阐述我国家庭教育权保障中的困境,包括立法保障的缺失、家庭权利意识不足以及相关的家庭教育指导专业化服务水平不高,在这些困境的基础上探讨相关对策建议。第五章节是对文章中论述的家庭教育权的内容进行总结。
[Abstract]:Ten years of trees, a hundred years of people. Education is a strategic work for a country, education is not only an important way to improve the quality of the people, but also an important link to enhance the comprehensive strength of the country. With the further development of market economy, people are calling for the diversified education form and the high quality of education. Moreover, at the "two sessions" in recent years, some deputies proposed that special legislation should be enacted to protect the right to family education; at the same time, some deputies also proposed to attach importance to family education from the perspective of solving the problem of "sky-high school district housing." These proposals put the right to education in the public eye. However, the parents are the first teachers of the children, and the family is also the natural harbor for the children to grow up. The importance of family education to the development of a child's physical and mental health is self-evident, but on the legislative level, There is no explicit provision in the law to protect the right to family education, so that family education becomes the "appendage" of school education. On the theoretical level, the domestic scholars' research on family education focuses on the state, school education and the specific methods of family education, the research on the right to family education is relatively scarce; in the practical level, Parents lack attention and understanding of the right to family education. Therefore, the improvement of the right to family education has the dual significance of promoting education and promoting the process of rule of law. Before the introduction of family education law, this paper begins with the problems existing in the protection of family education rights, analyzes the difficulties in the protection of family education, and based on the national conditions of our country. Based on some experiences and practices in the legislation of family education abroad, this paper provides some solutions to the problems encountered in the process of guaranteeing the right to education in the family. The full text is divided into five chapters. The first chapter is the introduction, including the main background and significance of the study. The second chapter is an overview of the right to family education, mainly from the family education, the meaning and content of the right to family education, but also the rights related to family education rights are analyzed. The third chapter discusses the theoretical basis of the right to family education, including the parental right of the right source and the right proof of the right to family education. The fourth chapter describes the difficulties in the protection of the right to family education in China, including the lack of legislative protection, the lack of awareness of family rights, and the lack of professional service level of related family education guidance. On the basis of these dilemmas, this paper discusses the relevant countermeasures and suggestions. The fifth chapter summarizes the content of family education right discussed in the article.
