消费者个人信息法律保护机制研究

【摘要】:随着市场经济的发展,互联网的广泛应用,经营者为了能在竞争中保持优势,收集、保存了大量的消费者个人信息。同时信息技术的发展使得个人信息的批量处理和传递变得简便,消费者个人信息不断遭到不当收集、恶意使用和篡改,进而侵扰消费者的私人生活。信息化时代下,我们在工作和生活中享受便捷的同时,消费者个人信息的保护也面临了前所未有的挑战。消费者个人信息法律保护机制的研究具有很强的实践意义,本文主要从探讨消费者个人信息的内涵和外延出发,总结了目前消费者个人信息存在着不合理利用,不恰当泄露和非法交易等几种侵权表现形式。着重分析了在消费者个人信息保护方面存在的问题及不足,,例如个人信息保护内容片面,专门性法律缺失;个人信息保护的系统性和操作性差;个人信息保护管理机构不健全;消费者个人信息保护意识薄弱等。最后在借鉴国外经验的基础上提出了保护我国消费者个人信息的具体措施及建议。 本文共五部分: 第一部分从探讨个人信息及消费者个人信息等概念出发,引出对消费者个人信息的内涵和外延的分析,阐述了关于消费者个人信息的特点以及分类。 第二部分从我们生活中切实存在的个人信息安全隐患着手,总结了目前存在的消费者个人信息的不合理利用,不恰当泄露和非法交易等侵权表现形式。 第三部分从目前我国消费者个人信息保护的现状出发,着重分析了在消费者个人信息保护方面存在的问题及不足,专门性的法律缺失,个人信息保护内容片面;个人信息保护管理机构不健全;消费者个人信息保护意识薄弱等等。 第四部分重点分析了欧盟、美国、日本以及我国台湾和香港地区对于消费者个人信息采取的不同保护模式,指出欧洲的统一立法模式和美国的行业自律模式以及台湾地区的个人资料保护法对我国消费者个人信息保护模式的有益借鉴。 第五部分重点提出了保护我国消费者个人信息的具体措施及建议,分别从专门性法律的制定,民事补偿机制的确立,个人监督管理机构的明确,政府、行业协会以及网络对消费者个人信息的监管等方面进行了阐述。
[Abstract]:With the development of the market economy and the wide application of the Internet, in order to maintain the advantage in the competition, the operators collect and preserve a large number of consumer personal information. At the same time, the development of information technology makes the batch processing and transmission of personal information easy, and consumers' personal information is constantly improperly collected, maliciously used and tampered with, thus intruding upon the private life of consumers. In the information age, while we enjoy convenience in our work and life, consumer personal information protection is also facing unprecedented challenges. The research on the legal protection mechanism of consumer personal information is of great practical significance. This paper mainly discusses the connotation and extension of consumer personal information, and summarizes the unreasonable use of consumer personal information at present. Improper disclosure and illegal transactions and other forms of infringement. The problems and shortcomings in the protection of consumer personal information, such as the one-sided content of personal information protection, the lack of specialized laws, the poor system and operation of personal information protection, the unsound management organization of personal information protection, are analyzed emphatically. Consumer personal information protection awareness is weak. Finally, on the basis of using foreign experience for reference, the author puts forward some concrete measures and suggestions to protect the personal information of consumers in our country. This paper consists of five parts: The first part discusses the concept of personal information and consumer personal information, leads to the analysis of the connotation and extension of consumer personal information, and expounds the characteristics and classification of consumer personal information. The second part begins with the hidden danger of personal information security in our life, summarizes the existing consumer personal information unreasonable use, improper disclosure and illegal transactions and other forms of tort. The third part starts from the present situation of consumer personal information protection in our country, focusing on the analysis of the problems and deficiencies in consumer personal information protection, the lack of specific laws, and the one-sided content of personal information protection. Personal information protection management organization is not perfect; consumer personal information protection awareness is weak and so on. The fourth part focuses on the analysis of the European Union, the United States, Japan and China's Taiwan and Hong Kong to the consumer's personal information protection model. It is pointed out that the uniform legislation model in Europe, the industry self-discipline model in the United States and the personal data protection law in Taiwan are useful references to the consumer personal information protection model in China. The fifth part focuses on the specific measures and suggestions for the protection of consumer personal information in China, respectively, from the formulation of special laws, the establishment of civil compensation mechanisms, the clarity of individual supervision and management agencies, the government, The industry association and the network to the consumer personal information supervision and so on has carried on the elaboration.
