拒不支付劳动报酬罪立法之反思

【摘要】:《刑法修正案(八)》增设的拒不支付劳动报酬罪从产生到实施至今以来,其合理性一直以来均遭到多方质疑。虽然刑法打击违法行为的威慑力有目共睹,但并非利用刑法规制拒不支付劳动报酬的行为就能取得良好的法律效果。从本质上看,拒不支付劳动报酬的行为属于民事纠纷的范畴,在尚未穷尽或完善其他救济措施之前,就贸然地利用刑法进行规制,将不可避免地会产生剥夺人们对刑法尊重感等诸多的负面效应,最终反而不利于保障被害人的权益。因此,在具体规制路径中,应当重视民事措施的重要作用,具体而言,应当增强民法治理措施的执法力度,强化相关公职人员的履职意识,构建多措施解决路径等,只有穷尽了以上措施且未能取得良好的治理效果时,才能考虑利用刑法进行规制。
[Abstract]:Since the establishment of the crime of refusing to pay the remuneration of labor, the rationality of the crime of refusing to pay labor remuneration has been questioned by many parties. Although the deterrent power of the criminal law against illegal acts is obvious to all, it is not the use of criminal law to regulate the refusal to pay labor remuneration can achieve a good legal effect. In essence, the refusal to pay labor remuneration belongs to the category of civil disputes, before the exhaustion or improvement of other relief measures, the criminal law is used hastily to regulate, It will inevitably have many negative effects, such as depriving people of the sense of respect for the criminal law, and ultimately will not benefit the protection of the rights and interests of the victims. Therefore, in the specific regulation path, we should attach importance to the important role of civil measures, specifically, we should strengthen the law enforcement of civil law governance measures, strengthen the awareness of relevant public officials, and build a multi-measures to solve the path, etc. Only when we exhaust the above measures and fail to achieve good governance effect, can we consider the use of criminal law to regulate.
