比较法视野下的警察盘查行为

【摘要】：警察实施盘查行为是警察权的主要内容之一,它在发现、预防、制止违法犯罪活动以及查缉犯罪嫌疑人、消除治安危害等方面起着非常重要的作用;但同时,盘查权的行使又与公民的人身自由权、隐私权等基本权利密切相关,行使不当有可能侵害公民的合法权益。对盘查行为的有关基本问题进行概括阐述,对有关国家或地区盘查的相关立法与实践进行比较,可以发现警察盘查行为近几十年的发展变化,对完善盘查权具有重要借鉴价值。
[Abstract]:As one of the main contents of the police power, the police's conduct of interrogation plays a very important role in discovering, preventing and suppressing illegal and criminal activities, investigating and arresting criminal suspects, eliminating public security hazards, and so on; but at the same time, it plays a very important role in the detection, prevention, and suppression of illegal and criminal activities. The exercise of the right to check is closely related to the basic rights of the citizen, such as the right to personal liberty and the right to privacy, and improper exercise may infringe upon the legitimate rights and interests of citizens. This paper generalizes the basic problems of the investigation behavior, compares the relevant legislation and practice of the relevant countries or regions, and finds out the development and change of the police checking behavior in recent decades, which has important reference value for the perfection of the inspection power.
