【摘要】：食品是人类生存发展过程中的必需品,食品问题不仅关系到人类最基本的日常生产生活需要,更影响到国家的发展和社会的稳定。食品安全问题已然成为公共安全的重要组成部分,越来越受到各国政府的关注。同时,为社会公众提供安全的食品也是政府的一项重要职责,而政府的行政执法活动则是保障食品安全的重要举措。近年来,我国食品安全事故频发,虽然目前《食品安全法》已经颁布,该法对食品安全行政执法主体的具体职权及职责也做出了较为明确的规定,但其权责的行使及履行方面仍然存在许多问题,主要表现在执法的权责行使及履行不到位、执法人员素质较差、食品安全问题社会参与性不足等方面,致使《食品安全法》的立法目的无法实现,难以从根本上解决食品安全的问题,恢复公众对食品安全的信心。因此,本文对我国食品安全行政执法问题予以研究,分析我国目前食品安全行政执法面临的困境与问题,并对国外食品安全行政执法的现状进行整理分析,总结可借鉴的先进经验。此外,本文将行政法相关理论与我国食品安全行政执法实践相结合,为完善我国食品安全行政执法制度提供可行性的意见和建议,解决食品安全行政执法活动中存在的问题,尽量避免食品安全事故的发生。通过依法行政,运用公正、高效地执法手段,使存在安全隐患的食品无法进入市场的流通领域,以保障公众“舌尖上的安全”。
[Abstract]:Food is a necessity in the process of human survival and development. The food problem not only relates to the basic daily production and life needs of human beings, but also affects the development of the country and the stability of the society. Food safety has become an important part of public safety and has been paid more and more attention by governments. At the same time, providing safe food for the public is also an important duty of the government, and the government's administrative law enforcement is an important measure to ensure the food safety. In recent years, food safety accidents have occurred frequently in our country. Although the Food Safety Law has been promulgated at present, the law has made clear provisions on the specific powers and duties of the main body of food safety administration law enforcement. However, there are still many problems in the exercise and implementation of their powers and responsibilities, which are mainly reflected in the inadequate exercise and implementation of the powers and responsibilities of law enforcement, the poor quality of law enforcement personnel, the insufficient social participation in food safety problems, and so on. It is difficult to solve the problem of food safety and restore public confidence in food safety. Therefore, this paper studies the problem of food safety administrative law enforcement in China, analyzes the difficulties and problems faced by food safety administrative law enforcement in China at present, and analyzes the current situation of food safety administrative law enforcement in foreign countries. Summarize the advanced experience that can be used for reference. In addition, this paper combines the relevant theories of administrative law with the practice of food safety administrative law enforcement in China to provide feasible advice and suggestions for perfecting the food safety administrative law enforcement system, and to solve the problems existing in the food safety administrative law enforcement activities. Try to avoid food safety accidents. In order to ensure the public's "safety on the tip of the tongue", the food with hidden safety problems can not enter the circulation field of the market by the means of administration according to law and using fair and efficient law enforcement means.
