预防和处置群体性事件的法律对策研究

【摘要】：当前,我国正处于经济体制深刻变革、社会结构巨大变动和利益格局剧烈调整的社会转型期,社会矛盾日益突出,由此引发的群体性事件已经成为影响社会稳定和发展的突出性问题,同时也成为新时期维护社会稳定的新难点。如何积极预防和妥善处置群体性事件是新形势下维护社会稳定的一个重要课题,也是目前学界很热门的一个研究课题。我们试图以法学研究为视角,明确界定群体性事件的概念,认真分析近几年我国群体性事件呈现出的新特点,客观评价群体性事件的正反功能,并从公民权利的法律保障机制不健全、公权力运行体制不完善和处置群体性事件的机制不完备等三个角度深入剖析当前我国法律在群体性事件的预防和处置中存在的问题和缺陷,最终对症下药。笔者主要从完善公民权利的法律保障机制、进一步规范公权力运行机制和健全群体性事件的应急处置机制等三个方面提出些许有建设性意义的预防和处置群体性事件的法律对策,期望对我国预防和处置群体性事件方面的立法研究和实践工作有所裨益。
[Abstract]:At present, China is undergoing a period of social transformation, in which the economic system is undergoing profound changes, the social structure is undergoing tremendous changes and the pattern of interests is drastically adjusted. The social contradictions are becoming increasingly prominent. The group event has become a prominent problem affecting social stability and development, and it has also become a new difficulty in maintaining social stability in the new period. How to actively prevent and properly deal with mass incidents is an important issue in maintaining social stability under the new situation, and is also a hot research topic in academic circles at present. We try to define the concept of group events from the perspective of legal research, analyze the new features of group events in China in recent years, and objectively evaluate the positive and negative functions of group events. And from the legal protection mechanism of civil rights is not perfect, From the three angles of imperfect operation system of public power and incomplete mechanism of dealing with group incidents, the problems and defects existing in the prevention and treatment of group incidents in the current law of our country are analyzed in depth, and finally the remedy is given to the case. The author mainly from the perfection of the legal protection mechanism of civil rights, Further standardizing the operation mechanism of public power and perfecting the emergency handling mechanism of mass incidents, the author puts forward some constructive legal countermeasures to prevent and deal with group incidents. It is expected to be of benefit to the legislative research and practice in the prevention and treatment of mass incidents in China.
