论行政合同中行政优益权及其控制

【摘要】:行政合同是行政主体以合同方式执行公务为实现行政管理目标而采取的一种新型的行政管理手段和行政活动方式,越来越受到关注和重视。行政合同与行政主体采取的其他行政管理手段和活动方式相比较,它显得更加温和与开放,易于接纳,实践中收效良好。行政合同中行政优益权是指行政主体出于维护公共利益的需要,在法律明确规定的情况下,在与相对人就有关事项协商不能达成意见一致时,而不必征得相对人的同意,依法享有合同履行监督权、单方变更解除终止权、行政制裁权等权力。一方面行政主体行使行政优益权是为了保障公共利益及实现行政管理目标;另一方面行政优益权也是一种特殊的行政权力,如果不进行有效的监督和控制,极有可能侵害行政相对人的合法权益。行政主体在行使行政优益权时,往往打着“公共利益”的旗号,变相的胁迫行政相对人并作为“筹码”,进行权力寻租,容易滋生腐败。实践中,对“公共利益”的判断标准是由行政主体一方说了算,加上我国对“公共利益”的概念界定不明确性和模糊性,使得行政主体极有可能滥用行政优益权。鉴此,本文从介绍行政合同中行政优益权相关概念、内容、存在的必要性、与一般行政优益权的区别以及分析行政优益权存在的问题,,再分析西方国家行政优益权制度比较与我国行政优益权理论现状,最后针对行政优益权存在的问题,如何构建行政合同中行政优益权的控权模式,切实保障行政相对人的合法权益不受侵害。 本文结构分为绪论、正文、结语三大部分。绪论部分主要介绍本论文研究理论与现实意义、国内外研究现状、研究方法以及研究进路。正文分为三部分。首先,介绍行政合同和行政合同中行政优益权的概念、行政优益权的内容、行政优益权存在的必要性、与一般行政优益权的区别,以及论述行政优益权存在的问题。其次,对法德、英美等国家行政优益权制度进行比较分析以及从我国行政优益权的理论分析得出有益的借鉴与启示。最后,针对行政优益权存在的问题提出合理可行的控权模式和完善建议。 结语是对本文的综合概括。通过论述行政合同中行政优益权存在的问题,为了防止行政合同中行政优益权的滥用,寻找公权力与私权的平衡点,探讨行政优益权的控权模式,达到控权的效果,切实保护行政相对人的合法权益不受少受侵害,最终实现行政合同内在动态平衡的价值理念。
[Abstract]:Administrative contract is a new type of administrative means and mode of administrative activities, which is adopted by the administrative subject to carry out his official duties by way of contract, and has been paid more and more attention to. Compared with other administrative means and activities adopted by administrative subjects, administrative contracts are more moderate and open, easy to accept, and have good results in practice. In the administrative contract, the administrative advantage right refers to the administrative subject's need to safeguard the public interest, when the law clearly stipulates that the administrative subject cannot reach an agreement in consultation with the relative party on the relevant matters, and does not need to obtain the consent of the relative party. According to law, the right to supervise the performance of the contract, the right to terminate unilateral changes, the right to administrative sanctions and other powers. On the one hand, the administrative subject exercises the administrative superior interest right to protect the public interest and realize the administrative management goal; on the other hand, the administrative superior interest right is also a special administrative power, if there is no effective supervision and control, It is very likely to infringe upon the legitimate rights and interests of the administrative counterpart. When the administrative subject exercises the right of administrative superior interest, it often uses the banner of "public interest" to coerce the relative party of the administration in disguised form and act as a "bargaining chip" to seek rent for power, which is easy to breed corruption. In practice, the judgment standard of "public interest" is decided by the party of the administrative subject, and the definition of "public interest" in our country is not clear and vague, which makes it possible for the administrative subject to abuse the right of administrative superior interest. In view of this, this paper introduces the concept, content, necessity of the administrative superior right in the administrative contract, the difference between the administrative superior interest right and the general administrative superior interest right, and analyzes the problems existing in the administrative superior interest right. Then it analyzes the comparison of the administrative superior right system in western countries and the present situation of our country's administrative superior interest right theory. Finally, aiming at the problems existing in the administrative superior interest right, how to construct the control mode of the administrative superior interest right in the administrative contract. Ensure that the legitimate rights and interests of the administrative counterpart are not infringed upon. The structure of this paper is divided into three parts: introduction, text and conclusion. The introduction mainly introduces the theoretical and practical significance of this paper, the current research situation at home and abroad, research methods and research approaches. The text is divided into three parts. First of all, it introduces the concept of administrative superior right in administrative contract and administrative contract, the content of administrative superior interest right, the necessity of the existence of administrative superior interest right, the difference between administrative superior interest right and general administrative superior interest right, and discusses the problems existing in administrative superior interest right. Secondly, the author makes a comparative analysis of the administrative preferential right system in France, Germany, Britain and the United States, and draws useful lessons from the theoretical analysis of the administrative superior interest right in our country. Finally, the paper puts forward reasonable and feasible control mode and perfect suggestions for the problems existing in administrative superior right. The conclusion is a comprehensive summary of this paper. In order to prevent the abuse of administrative superior interest right in administrative contract, to find the balance point between public power and private right, to discuss the control mode of administrative superior interest right, and to achieve the effect of control right by discussing the problems existing in administrative contract. To protect the legitimate rights and interests of the administrative counterpart from being infringed, and finally to realize the intrinsic dynamic balance of the administrative contract.
