行政指导中相对人权利保障研究

【摘要】：在行政法领域中，行政指导因其灵活性和柔和性成为我国行政管理活动中所广泛采用的手段之一，发挥着不可替代的良性作用。然而，由于行政指导在我国出现的较晚，其理论研究和立法的滞后性都给行政指导的实施带来了阻碍。在行政指导实务中，因行政主体享有较大的自由裁量权，行政相对人的合法权利时常受到忽视，不仅没有达到行政目标的实现，，也是对政府公信力的严峻考验。从行政指导中行政相对人权利保护的角度出发，对相对人的参与权、知情权、受平等对待权和救济权分别进行探析，提出对我国行政指导的相关立法、基本原则、程序和监督救济途径等相关内容进行法律规制，从而为行政指导中行政相对人的合法权益提供坚实的保障。
[Abstract]:In the field of administrative law, administrative guidance plays an irreplaceable and benign role because of its flexibility and softness. However, due to the late emergence of administrative guidance in China, its theoretical research and legislation lag behind the implementation of administrative guidance has brought obstacles. In the practice of administrative guidance, the legal rights of the administrative counterpart are often ignored because the administrative subject enjoys greater discretion, which not only fails to achieve the administrative goal, but also is a severe test to the credibility of the government. From the point of view of the protection of the rights of the administrative counterpart in the administrative guidance, this paper analyzes the right of the counterpart to participate in, the right to know, the right to equal treatment and the right to relief, and puts forward the relevant legislation and basic principles for the administrative guidance of our country. The relevant contents such as procedure and supervision remedy are regulated by law, thus providing solid protection for the legal rights and interests of administrative counterpart in administrative guidance.
