我国电视娱乐节目的行政规制

【摘要】:我国电视娱乐节目类型繁多,收视率的盲目助推造成了娱乐喧嚣,呈现出混乱无序的现象。部分节目格调不高,内容低俗,粗制滥造痕迹明显。为了加强对电视娱乐节目低俗化与过度娱乐化的行政规制,国家新闻出版广电总局出台了一系列文件,这些文件由于法律位阶较低、评价标准不清晰以及对创作者表达自由的限制等引来很大争议。但是目前,对电视娱乐节目行政规制的研究多是框架性、呼吁性的研究,对于如何弥补相关法律的空白、建构科学的电视娱乐节目规制体系,提出有效建议的较少;对于如何衡量公权力与私权利、创作者与受众利益,提出科学公正规制方法的研究深度不够。因此,本文试图通过对相关政策文件进行深入分析,对这些问题给予一些行之有效的建议。本文第一部分是电视娱乐节目行政规制的理论基础。宪法保护公民的表达自由和文化权利,但在保护的同时也给予其一定限制,这给规制部门的行政规制提供了宪法上的依据。虽然这一行政规制有宪法上的依据,但也应注意度的把握,不能随意侵犯电视娱乐节目创作者的表达自由。本文第二部分是电视娱乐节目行政规制现状与问题透视。对规制依据、规制内容、规制特点进行分析并从微观上对一些行政禁令进行解读,可以发现规制过程中存在的一些问题,主要是法律体系不健全、对各方利益的限制违反比例原则、评判标准模糊不清晰以及规制程序不正当。本文第三部分是域外娱乐节目行政规制的梳理。不管是东方国家还是西方国家对低俗节目都持低容忍的态度,因此世界各国都采取各种规制措施对低俗节目予以遏制。域外在电视娱乐节目规制上存在一些共通的做法,主要有制订相关法律、对节目进行分级、界定明晰具体标准。本文最后一部分是完善我国电视娱乐节目行政规制的构想。这一章是在前几章分析的基础上,从自律与他律相结合的角度提出一些完善建议。政府需要通过健全法律体系、建立节目分级制度、界定明晰审查标准、规范规制程序等来构建一个科学的电视娱乐节目规制体系,同时与电视行业、电视媒体的自律相结合,只有多方联动,形成合力,才能形成长效化机制。
[Abstract]:There are many kinds of TV entertainment programs in our country. The blind booting of ratings causes the entertainment noise and presents a chaotic phenomenon. Part of the program style is not high, the content vulgar, rough marks obvious. In order to strengthen the administrative regulations on the vulgarization and over-entertainment of television entertainment programs, the State Administration of Press, publication, Radio, Film and Television has issued a series of documents. Unclear evaluation criteria and restrictions on creators' freedom of expression are controversial. However, at present, the research on the administrative regulation of TV entertainment programs is mostly frame, appealing research, for how to make up for the gaps in the relevant laws, the construction of a scientific system of television entertainment programs regulation system, put forward less effective suggestions; How to measure public and private rights, the interests of creators and audiences, the research depth of scientific and just regulation method is not enough. Therefore, this paper attempts to give some effective suggestions on these issues through in-depth analysis of relevant policy documents. The first part of this paper is the theoretical basis of the administrative regulation of TV entertainment programs. The Constitution protects citizens' freedom of expression and cultural rights, but it also restricts them at the same time, which provides constitutional basis for administrative regulation of regulatory departments. Although this administrative regulation has constitutional basis, it should also pay attention to the assurance that it should not encroach on the freedom of expression of the creators of TV entertainment programs at will. The second part of this paper is the current situation and perspective of the administrative regulation of TV entertainment programs. By analyzing the basis of regulation, the content and characteristics of regulation, and analyzing some administrative injunctions microscopically, we can find some problems existing in the process of regulation, mainly because the legal system is not perfect. Restrictions on the interests of all parties violate the principle of proportionality, fuzzy criteria and improper regulatory procedures. The third part of this article is the outside-country entertainment program administrative regulation combs. Both eastern and western countries hold low tolerance for vulgar programs, so all countries in the world take various regulatory measures to curb vulgar programs. There are some common practices in the regulation of TV entertainment programs in foreign countries, such as making relevant laws, classifying programs and defining specific standards. The last part of this paper is the idea of perfecting the administrative regulation of TV entertainment programs in China. This chapter is based on the analysis of the previous chapters, from the perspective of the combination of self-discipline and heteronomy put forward some suggestions. The government needs to establish a scientific regulation system of TV entertainment programs by perfecting the legal system, establishing a program classification system, defining clear censorship standards, standardizing the regulatory procedures, and combining with the self-discipline of the television industry and the television media. Only the multi-party linkage, the formation of joint forces, can form a long-term mechanism.
