对虞城县逃避服兵役事件法律问题分析

【摘要】：随着世界经济的迅速发展,我国国家实力稳步提升,国际地位日趋提高,然而我国周边环境的安全形势并不乐观。我国一贯坚持的和平发展战略为国家的发展提供了良好的环境,但却致使部分公民缺少居安思危的危机意识及日渐忽略国防建设的重要性,以致逃避服兵役等类似事件频频发生,使部队的对外形象受到负面影响,进一步影响了国家国防事业的建设。本文按照提出问题、分析问题、解决问题的思路进行,通过对虞城县五名青年逃避服兵役事件的深入分析,从公民的服兵役义务、对拒服兵役行为的具体分析、对逃避服兵役行政处罚的法律分析、逃避服兵役的法律责任问题分析,在对该事件深刻反思的同时,对相关问题提出对策。在深刻认识该事件的基础上,以期指导我国服兵役工作的顺利开展,为我国国防事业的建设提供坚实的保障。
[Abstract]:With the rapid development of the world economy, the national strength of our country is rising steadily and the international position is improving day by day. However, the security situation of our country's surrounding environment is not optimistic. The peaceful development strategy that our country has always adhered to has provided a good environment for the development of our country, but it has led some citizens to lack a sense of crisis to raise vigilance and to neglect the importance of national defense construction day by day. As a result, such incidents as evading military service occurred frequently, which adversely affected the external image of the army and further affected the national defense construction. According to the train of thought of putting forward, analyzing and solving problems, this paper analyzes the behavior of refusing to perform military service from the point of view of citizen's duty of military service, through the in-depth analysis of five young people in Yucheng County who evaded military service. The legal analysis of the administrative punishment of avoiding military service and the analysis of the legal responsibility of evading military service, while deeply reflecting on the incident, put forward some countermeasures to the related problems at the same time. On the basis of deep understanding of the incident, this paper hopes to guide the smooth development of military service in our country and provide a solid guarantee for the construction of national defense in our country.
