我国公务员考试录用法律制度研究

【摘要】:自1994年至2015年,我国公务员公开考试录用已连续招考22次。二十余年,公务员考录制度取得了巨大进步,但在考录过程中诸如法律理论研究薄弱,报名资格限定违宪,考试方法单一,考录体系缺乏明确法律规定等问题仍然存在。公务员考试录用法律制度是贯彻落实好《公务员法》的前提和基础,因此,完善公务员考试录用法律制度,使其更趋科学、民主、合法尤为重要。文章以现行我国中央和地方各级公务员考试录用中的相关法律、法规、政策为研究对象,结合实践经验,通过文献分析、比较分析、个案分析等研究方法进行综合分析、比较,指出我国当前公务员考试录用过程中出现的问题,对问题的社会性、文化性、制度性根源进行深究、探讨,随后综合我国公务员考试录用原则,执政党的方针政策以及当前我国社会经济文化现状等各类信息,给以论证完善我国公务员考试录用制度的可行性。文章最后对二十余年我国公务员考试录用的实践经验进行归纳总结,结合自身对公务员考试录用法律制度的理论学习,以实践和理论融会贯通并加以提炼升华,对完善我国公务员考试录用制度提出可行性、创新性建议。
[Abstract]:From 1994 to 2015, civil servants have been recruited 22 times in a row. More than 20 years, the civil servant examination system has made great progress, but in the examination process, such as weak legal theory research, limited registration qualification unconstitutional, single examination method, lack of clear legal provisions of the examination system still exist. The legal system of examination and employment of civil servants is the premise and foundation of carrying out the Civil servant Law well. Therefore, it is very important to perfect the legal system of examination and employment of civil servants and make it more scientific, democratic and legal. This article takes the relevant laws, regulations and policies in the examination and employment of civil servants at the central and local levels as the research object, and combines the practical experience, through the literature analysis, comparative analysis, case analysis and other research methods to conduct comprehensive analysis and comparison. This paper points out the problems in the process of civil servant examination in our country, probes deeply into the social, cultural and institutional root of the problem, and then synthesizes the principles of civil servant examination in our country. The principles and policies of the ruling party and the current situation of social economy and culture in our country are all kinds of information to demonstrate the feasibility of perfecting the examination and employment system of civil servants in our country. At the end of the article, the author sums up the practical experience of civil servant examination recruitment in China for more than 20 years, combines with his own theoretical study of the civil servant examination employment legal system, and refines and sublimates it through practice and theory. Put forward the feasibility and innovative suggestion to perfect our country civil servant examination employment system.
