论我国食品安全责任强制保险法律制度的构建

【摘要】：在我国建立食品安全责任强制保险制度具有一定的必要性与合理性,企业、政府必须共同承担保证食品安全事故造成的人身损害赔偿责任能够得到充分履行的义务。食品安全责任强制保险与商业责任保险在性质与目的上并不相同,我国目前的食品安全强制责任保险应当定位于一种以补偿受害者人身损害为主的强制投保的政策型保险,井在此基础上对费率、风险调控以及赔偿等方面进行符合其定位的设计。
[Abstract]:It is necessary and reasonable to establish the compulsory insurance system of food safety liability in our country. Enterprises, the government must jointly assume the obligation to ensure the compensation for personal injury caused by food safety accidents can be fully fulfilled. The nature and purpose of food safety compulsory insurance and commercial liability insurance are different. At present, the food safety compulsory liability insurance in our country should be defined as a kind of policy type insurance which mainly compensates the victim for personal injury. On this basis, the well to rate, risk control and compensation and other aspects of the design in accordance with its positioning.
