法典化潮流下的劳动法判例制度研究

【摘要】：伴随民法法典化潮流,在相对独立的劳动法领域建立一种具有自身特色的判例制度与我国成文法传统并不冲突。作为法律解释的一种规范化模式,劳动法判例不仅可以保证劳动法律解释的客观性和裁判标准的统一性,也有利于增强劳动法的社会适应性和法律的确定性,实现法律知识的自我累积与发展。赋予判例以法律拘束力,确认判例可以直接援引的法源地位,符合我国劳动法制的实践。劳动法判例的遴选、变更应该由法定的个案审判组织完成。新一轮司法改革为劳动争议审判制度的完善带来了机遇,劳动法判例制度的试行可以为整个法律体系判例制度的推广积累经验。
[Abstract]:With the trend of codification of civil law, it is not in conflict with the tradition of statute law to establish a case system with its own characteristics in the field of relatively independent labor law. As a standardized mode of legal interpretation, the precedent of labor law can not only guarantee the objectivity of labor law interpretation and the unity of judgment standard, but also enhance the social adaptability and legal certainty of labor law. To realize the self-accumulation and development of legal knowledge. Giving legal binding force to the case, confirming the legal source status that the precedent can directly invoke, accords with the practice of our country's labor legal system. The selection of the labor law case, the change should be completed by the legal case trial organization. The new round of judicial reform has brought the opportunity for the perfection of the labor dispute trial system. The trial of the precedent system of labor law can accumulate experience for the popularization of the case system of the whole legal system.
