【摘要】：随着国民经济的不断发展、人民的物质生活的平的不断提高,人民对于衣食住行的要求也逐渐提高,特别是作为民本的“食”上,已经不仅仅是要求吃饱这么简单,吃好,吃的放心、安全,才是国民的基本要求。而近年来,经济繁荣的背后,环境污染等诸多问题也逐渐显露,而食品安全问题作为威胁国民生命与健康这一基本权利的问题,也越来越严重并呈现多元化的趋势。而小作坊作为食品安全问题的高发区,对其在法律规制方面的研究,有助于我国食品安全的构建。对于小作坊食品安全的法律规制与一般的食品安全法律规制一样都还处于初级探索阶段,很多方面都还不成熟,具体表现在我国的小作坊食品安全的法律规制采用的是分散立法,立法权限下放的模式,存在各地法律规定不统一,立法技术落后,法律内容缺乏可操作性,重处罚而轻监管等等问题。这些问题严重的影响了小作坊的食品安全问题,无论是对小作坊主的规制,还是对政府监管的规制,亦或是对第三方机构的规制,都存在很多缺陷,需要进一步的完善。本文旨在通过研究小作坊食品安全法律规制,来解决小作坊的食品安全问题,从而保障民众的生命和健康权。本文采用文献、比较、网络博弈等研究方法进行研究,在借鉴别人研究成果的同时,根据自己的工作实践,比较国外的先进做法,对小作坊食品安全问题、小作坊食品安全问题的法律规制上存在的问题进行了分析,并对小作坊食品安全法律规制上存在的问题进行分析,找到产生这些问题的原因:立法理念、法律体系以及具体制度设计上的不足。文章最后一部分对于这些原因,借鉴国外的先进做法,也从三个方面提出了完善法律规制的一些建议和意见:立法理念上,注重对消费者利益的保护;法律体系上,提高法规的可操作性;具体制度设计上,完善食品安全承诺制度等。文章内容包括四个部分:一是导论部分提出了该论文的研究背景、目的和意义,分析了国内外的文献综述,明确了研究思路和方法,并提出了本文的创新之处;二是阐述了小作坊食品安全法律规制的相关理论,包括涉及的相关概念和法律规制的基础;三是对小作坊的食品安全问题和法律规制现状进行了分析,主要对食品生产加工小作坊的主要特征和生存现状、法律规制的模式和存在的问题,以及对存在这些问题的原因进了分析。四是对法制完善提出了一些建议,主要从借鉴国际上的先进做法,从立法理念、立法体系,和具体的制度设计进行阐述。
[Abstract]:With the continuous development of the national economy and the constant improvement of the people's material life, the people's requirements for food, clothing, housing and transportation have been gradually raised. In particular, as a people-oriented "food", it is no longer just a simple requirement to eat enough, but to eat well. Rest assured that food, security, is the basic requirements of the nation. In recent years, many problems, such as environmental pollution, have been gradually revealed behind the economic prosperity, and food safety, as a basic right threatening the life and health of the people, is becoming more and more serious and showing a trend of diversification. As a high incidence area of food safety, the study on the legal regulation of small workshop is helpful to the construction of food safety in China. The legal regulation of food safety in small workshops is still in the primary stage of exploration, as is the general legal regulation of food safety, and many aspects are still immature. The legal regulation of food safety in small workshops in our country adopts the mode of decentralized legislation and decentralization of legislative authority. There are inconsistent laws and regulations, backward legislative techniques and lack of operability of legal content. Heavy punishment rather than supervision and so on. These problems seriously affect the food safety of small workshops, whether the regulation of small workshop owners, the regulation of government supervision, or the regulation of third parties, there are many defects, which need to be further improved. The purpose of this paper is to solve the problem of food safety in small workshops by studying the legal regulation of food safety in small workshops, so as to protect the people's life and health rights. This article uses the literature, the comparison, the network game and so on research method carries on the research, while drawing lessons from others' research achievement, according to own work practice, compares the foreign advanced practice, to the small workshop food safety question, This paper analyzes the problems existing in the legal regulation of food safety in small workshops, and finds out the reasons for these problems: the idea of legislation, Lack of legal system and specific system design. In the last part of the article, for these reasons, we draw lessons from the advanced practices of foreign countries, and put forward some suggestions and opinions on how to perfect the legal regulation from three aspects: the legislative concept, the protection of the interests of consumers, the legal system, Improve the maneuverability of laws and regulations, and perfect the food safety commitment system in the specific system design. The content of this paper includes four parts: first, the introduction part puts forward the research background, purpose and significance of the paper, analyzes the literature review at home and abroad, clarifies the research ideas and methods, and puts forward the innovation of this paper; The second is to elaborate the relevant theory of food safety regulation in small workshops, including the related concepts and the basis of legal regulation; third, to analyze the food safety problems and the current situation of legal regulation in small workshops. This paper mainly analyzes the main characteristics and survival status of food production and processing workshop, the mode of legal regulation and the existing problems, and the reasons for these problems. The fourth is to put forward some suggestions on the perfection of legal system, mainly from the reference of international advanced practices, from the legislative concept, legislative system, and specific system design.
