【摘要】：在行政法理论与法治快速发展,国家行政权限划分更加明确精细、社会实践事务日益复杂的今天,行政协助作为行政主体间相互帮助的一种方式,无论对于行政主体依法行政还是保障相对人的权益都具有重要意义。域外对行政协助制度有较为成熟的理论研究和立法,我国大陆当前尚未建立统一的行政协助制度,只是在一些单行法律、法规、规章或规范性文件中有原则、笼统的规定。但我国实践中存在大量的行政协助现象,由于缺乏统一立法的指导,实践中行政协助操作混乱、不规范。目前,学者们在行政协助的主体范围、发生条件、域外相关制度方面已经作了很多研究,在大量阅读、思考前人研究的基础上,本文拟对行政协助制度进行较为全面系统的研究,以期对丰富我国行政协助理论和立法有一定的参考。全文共包括五章,在引言部分简要介绍了行政协助制度的研究背景与意义、研究现状、研究内容、研究方法等,接下来是行政协助的内容概述章节。首先,对行政协助做了基本概述,阐述了行政协助的概念、特征以及功能,阐发了行政协助制度合理化基础;其次,介绍了我国行政协助制度的立法和实践现状,分析立法和实践方面存在的问题,例如,立法存在空白、操作性差、缺乏监督、硬件设施不足等;然后,通过对域外行政协助制度的立法介绍,探索构建我国的行政协助制度的可能借鉴或启示;最后,在以上论述的基础上,从宏观立法模式的选择,到细节具体的制度内容设计,为我国的行政协助制度的立法构建提出合理化建议,以期对我国行政协助制度的立法完善有所启发。
[Abstract]:With the rapid development of the theory of administrative law and the rule of law, the division of national administrative authority is more and more precise, and the social practice is increasingly complicated, administrative assistance is a way of helping each other among administrative subjects. It is of great significance for the administrative subject to administer according to law or to protect the rights and interests of the relative person. There are mature theoretical research and legislation on administrative assistance system outside China. At present, China has not yet established a unified administrative assistance system, only in some separate laws, regulations, regulations or normative documents in principle, general provisions. However, there is a large number of administrative assistance in practice in our country. Due to the lack of unified legislation, the practice of administrative assistance is chaotic and irregular. At present, scholars have done a lot of research on the subject scope of administrative assistance, conditions of occurrence, and extraterritorial related systems. On the basis of extensive reading and thinking of previous studies, This paper intends to make a comprehensive and systematic study on the system of administrative assistance in order to enrich the theory and legislation of administrative assistance in China. The full text includes five chapters, in the introduction part of a brief introduction of the administrative assistance system research background and significance, research status, research content, research methods and so on, followed by the administrative assistance content overview chapter. First of all, it gives a basic overview of administrative assistance, expounds the concept, characteristics and functions of administrative assistance, expounds the rational basis of administrative assistance system; secondly, it introduces the current legislation and practice of administrative assistance system in China. Analysis of legislative and practical problems, such as gaps in legislation, poor operability, lack of supervision, inadequate hardware facilities, etc., and then, through the introduction of legislation to the extraterritorial administrative assistance system, Finally, on the basis of the above exposition, from the choice of macro legislative model to the detailed system content design, This paper puts forward some reasonable suggestions for the legislative construction of the administrative assistance system in our country, in order to enlighten the legislative perfection of the administrative assistance system in our country.
