【摘要】：当前我国食品安全问题频发,对人民生命、财产权益造成极大损害。通过对我国当前食品安全立法、监管等现状的分析,可以看出当前的食品安全监官存在许多不足之处,存在立法滞后、监管不力等诸多问题。为了更好的保障人民的生命财产权益,我国食品安全监督可以以史为鉴,从唐宋时期食品安全监管中找到有益启示,以更好的解决当前食品安全领域中的法律监管问题。本文通过对唐宋时期食品安全的立法及监管执行情况进行研究分析,认为在唐宋之前,我国人民就已形成了朴素的食品安全观念,并颁布了食品安全监督的法律规范;发展到唐宋,食品安全监管逐步发展成为包括国家法典规范监管、颁布专门法律、诏令监管、民间行会监管等多个层次的一个严密的体系;同时通过对唐代、宋代的食品安全监管制度进行比较分析得出唐代的食品安全监管具有行政性的特征,宋代的食品安全监管也具有行政性特征,但呈现出更为多元的市场化监管的特征,并且宋代的食品安全监管具体方式在继承唐代监管措施的基础上,发生了法律、经济等方面的变化。本文通过对唐宋时期有关食品安全的立法、执法经验进行分析研究,比较研究得出当代食品安全监管应形成从政府到社会的全方位监管体系,食品安全立法应注重法律质量,食品安全立法应该建立严格的行业准入制度,应注重社会诚信建设。以对当前我国食品安全监督有所裨益。
[Abstract]:At present, China's food safety problems occur frequently, causing great damage to people's lives and property rights. Through the analysis of the current situation of food safety legislation and supervision in our country, we can see that the current food safety supervisor has many shortcomings, such as lagging legislation, weak supervision and so on. In order to better protect the people's rights and interests of life and property, China's food safety supervision can learn from history, from the Tang and Song dynasties food safety supervision to find useful inspiration, in order to better solve the current food safety in the field of legal supervision. Through the research and analysis of the legislation and supervision of food safety in the Tang and Song dynasties, the author thinks that before the Tang and Song dynasties, the people of our country have formed a simple concept of food safety and promulgated the legal norms of food safety supervision. In the Tang and Song dynasties, food safety supervision gradually developed into a strict system at many levels, including the regulation of the State Code, the promulgation of special laws, the supervision of imperial edict, the supervision of folk associations, and so on; at the same time, through the Tang Dynasty, The comparative analysis of the food safety supervision system in the Song Dynasty shows that the food safety supervision in the Tang Dynasty has the administrative characteristics, the food safety supervision in the Song Dynasty also has the administrative characteristics, but it shows the characteristics of more diversified market-oriented supervision. On the basis of inheriting the supervision measures of Tang Dynasty, the specific ways of food safety supervision in Song Dynasty have changed in the aspects of law, economy and so on. Through the analysis and research on the legislation and law enforcement experience of food safety in Tang and Song dynasties, the author draws a conclusion that the modern food safety supervision should form a comprehensive supervision system from the government to the society, and the food safety legislation should pay attention to the legal quality.
