论社会风险的法律防范

【摘要】：在社会学家眼中,当今社会是一个风险社会。为了更好地防范社会风险,促进社会稳定,必须深入分析社会风险的成因、影响,进而有针对性地提出防范社会风险的法律措施,才能有效地预防和化解社会风险。伴随社会经济发展而来的贫富差距拉大、弱势群体保护、利益诉求表达渠道单一,以及行政违法行为频现,是我国当前容易引发社会风险的重要因素,而运用法律手段防范社会风险有利于保证政府依法行政,实现社会的公平和正义,从而化解潜在的社会风险。具体的法律防范社会风险的措施包括:应引入社会组织的力量,建立社会利益均衡机制;畅通利益表达渠道,建设限权型与责任型政府;建立社会稳定指标体系、社会风险预警机制,以及常设性的风险管理综合协调机构,发挥预判和防范社会风险的重要作用。
[Abstract]:In the view of sociologists, today's society is a risk society. In order to better guard against social risks and promote social stability, it is necessary to analyze the causes of social risk and influence, and then put forward legal measures to prevent social risks so as to effectively prevent and dissolve social risks. The widening gap, the protection of the disadvantaged groups, the single expression channel of the interest appeal and the frequent administrative illegal activities are the important factors that lead to the social risk in our country at present, and the use of legal means to prevent the social risk is conducive to the government's administration in accordance with the law, the realization of the fairness and justice of the society, and the solution of the potential social risks. Measures to prevent social risk include: the strength of social organizations should be introduced, the balance mechanism of social interests should be established, the expression channels of interest express, the construction of the limited and responsible government, the establishment of the index system of social stability, the early warning mechanism of social risk, and the permanent and comprehensive coordination institutions of risk management, and the pre judgment and prevention of social risks.
