【摘要】：2008年全球金融危机的爆发从一个层面凸显以美元为中心的国际货币体系的弊端，中国政府意识到在贸易结算与投资领域过度依赖美元所存在的金融隐患。为减轻美元价值波动对中国资产价值带来的巨大冲击，中国积极参与货币互换，鼓励在贸易结算和金融交易中更多使用人民币，推进人民币国际化。香港、新加坡、伦敦和台湾均形成具有一定规模的人民币离岸市场，人民币回流问题也引起学者的关注。台湾作为具有独特政治环境的地区，在人民币回流渠道方面更加具有特殊性，其人民币大规模回流对大陆经济可能产生潜在的金融与法律风险，必须加以重视。本文以人民币国际化为背景，研究台湾地区人民币离岸市场的发展现状，，重点分析台湾地区人民币回流渠道及存在的金融与法律风险，并提出预防台湾地区人民币资金大规模回流的政策建议与法律建议。全文共四个部分。第一部分介绍台湾地区人民币资金回流问题产生的背景，主要介绍当前人民币国际化的概况和香港、新加坡以及伦敦离岸市场的现状，从理论与实践层面引出对台湾地区人民币离岸市场的研究。第二部分阐述台湾地区人民币离岸市场的发展现状，在梳理两岸货币合作发展历程的基础上，详细分析台湾地区建设人民币离岸市场的基础条件，初步发现，充足的货币供给、强劲的货币需求以及资金双向流动机制的基本建立使得台湾地区发展人民币离岸市场势头强劲。第三部分重点分析台湾地区人民币回流大陆的诸多渠道和潜在风险。首先梳理了我国关于人民币回流的相关法律文件，从而搭建起研究台湾地区人民币回流渠道的法律支撑。其次，从经常项目与资本项目下分别具体分析了台湾地区人民币回流的可能渠道。最后分析了台湾地区人民币大规模回流的潜在金融与法律风险。第四部分针对台湾地区人民币回流中的潜在风险提出相应的政策与法律建议。在政策方面，着力于拓宽人民币回流渠道，完善我国金融监管治理结构以及加强两岸金融监管合作。在法律方面，通过建立完善的人民币回流调控、规制、监管法律制度，来防范台湾地区人民币资金回流中的潜在法律风险。
[Abstract]:The outbreak of the 2008 global financial crisis highlighted the drawbacks of the dollar-centric international monetary system in a way that Beijing is aware of the financial pitfalls of over-reliance on the dollar in trade settlement and investment. To mitigate the huge impact of dollar volatility on the value of Chinese assets, China is actively involved in currency swaps, encouraging greater use of the renminbi in trade settlement and financial transactions, and promoting the internationalization of the renminbi. Hong Kong, Singapore, London and Taiwan have formed offshore renminbi markets of some size, and the issue of renminbi reflux has attracted attention from scholars. Taiwan, as a region with unique political environment, has more particularity in the channel of RMB return, and its large-scale return of RMB may bring potential financial and legal risks to the mainland economy, which must be paid more attention to. Based on the background of RMB internationalization, this paper studies the current situation of RMB offshore market in Taiwan, and analyzes the financial and legal risk of RMB reflux in Taiwan. And put forward to prevent the large-scale return of RMB funds in Taiwan policy recommendations and legal advice. There are four parts in this paper. The first part introduces the background of RMB capital return in Taiwan, mainly introduces the current situation of RMB internationalization and the offshore markets in Hong Kong, Singapore and London. From the theoretical and practical aspects of the study of the offshore market of RMB in Taiwan. The second part expounds the current situation of RMB offshore market in Taiwan. On the basis of combing the course of development of cross-strait monetary cooperation, it analyzes in detail the basic conditions for the construction of offshore RMB market in Taiwan, and preliminarily finds that there is sufficient money supply. Strong currency demand and the basic establishment of a two-way fund flow mechanism have made the development of the offshore renminbi market strong in Taiwan. The third part mainly analyzes the channel and potential risk of RMB returning to mainland in Taiwan. Firstly, this paper combs the relevant legal documents of RMB recirculation in China, and sets up the legal support for the research of RMB reflux channel in Taiwan. Secondly, the possible channels of RMB reflux in Taiwan are analyzed from current account and capital account respectively. Finally, the paper analyzes the potential financial and legal risks of large-scale RMB return in Taiwan. The fourth part puts forward corresponding policy and legal advice on the potential risk of RMB reflux in Taiwan. In the aspect of policy, we should widen the channel of RMB return, perfect the governance structure of financial supervision and strengthen the cooperation between the two sides. In the legal aspect, we should establish a perfect legal system to control, regulate and supervise the return of RMB to prevent the potential legal risks in the return of RMB funds in Taiwan.
