我国房地产宏观调控的法律规制研究

【摘要】:众所周知,我国的房地产市场在近几年来异常火爆,价格指数持续上升。而作为一、二线城市由于存在土地资源极其短缺的情况,因此存在楼市持续“升温”的现象。我国政府在2013年召开的两会当中再次强调了宏观调控的重要性地位,并推出了新的房地产宏观调控政策即“国五条”,2014年,为了进一步规范房地产市场的秩序,稳定房价,,作为新一届的政府明确表示,将继续对房地产市场坚持严格、稳健的宏观调控政策不动摇。在本篇文章中,我国对房地产市场价格的宏观调控政策主要有行政手段、法律手段、金融手段和税收手段,前提都是以法律政策为基础的宏观调控。还对我国当前存在的问题进行了逐一的分析,这样有利于更好的完善我国当前房地产宏观调控的法律问题。由于房地产问题在当今世界上任何一个国家都是热点问题,因此它必定会引起大家的广泛关注。而“高房价”更是当今一个炙手可热的话题,也是当今社会的一个难点问题。因此,我国政府为了进一步应对好当前存在的这种问题,采取了新一轮的房地产宏观调控对策。本篇文章主要由四大部分组成: 第一部分主要是对房地产宏观调控的基本概念和理论进行了系统的介绍和分析,结合了我国当前房地产行业的发展现状,进一步明确我国当前实行房地产宏观调控的必要性和紧迫性。第二部分主要是对我国房地产宏观调控进行了经济法分析,具体包括房地产宏观调控主体分析、房地产宏观调控受控主体分析、房地产宏观调控决策的合法性分析以及房地产宏观调控的主要方式分析。第三部分主要是对国外的房地产宏观调控制度进行研究与剖析。第四部分主要是完善我国房地产宏观调控的法律对策,主要从金融、税收、土地以及“国五条”四个方面进行了完善的建议。
[Abstract]:As we all know, China's real estate market in recent years is unusually hot, price index continues to rise. As a first, second-tier cities because of the extremely shortage of land resources, so there is a continuous "heating up" phenomenon of the property market. During the two sessions held in 2013, the Chinese government once again stressed the importance of macro-control, and introduced a new macro-control policy of real estate, that is, "National five rules." in 2014, in order to further standardize the order of the real estate market and stabilize housing prices, As the new government made clear, will continue to adhere to the real estate market strict, sound macroeconomic control policy will not waver. In this article, the macro-control policy of the real estate market price in China mainly includes administrative means, legal means, financial means and tax means, which are all based on the macro-control of law and policy. It also analyzes the existing problems one by one, which is helpful to perfect the legal problems of macro-control of real estate in our country. As the real estate problem is a hot issue in any country in the world today, it will cause widespread concern. And "high house price" is a hot topic today, is also a difficult problem in today's society. Therefore, in order to further deal with the existing problems, our government has taken a new round of real estate macro-control measures. This article consists of four parts: The first part is the introduction and analysis of the basic concepts and theories of real estate macro-control, combining the current development of the real estate industry in China. Further clarify the current implementation of real estate macro-control of the necessity and urgency. The second part mainly analyzes the macro-control of real estate in our country, including the subject of macro-control of real estate, and the subject of macro-control of real estate. The legitimacy of real estate macro-control decision and the main ways of real estate macro-control. The third part is the research and analysis of the real estate macro-control system abroad. The fourth part is to perfect the legal countermeasures of macro-control of China's real estate, mainly from the financial, tax, land and "national five" four aspects of perfect suggestions.
