论医疗责任强制保险制度的功能

【摘要】：医疗责任强制保险是指依法确立医疗机构及医务人员的强制投保义务,以分散医疗损害责任的风险,使受害患方的损失及时得以补偿的一种责任保险制度。实行医疗责任强制保险制度具有保护患方的合法权益和缓和医患矛盾、转移医疗风险和提高医疗科学技术水平、推进保险产品创新和确立保险市场规则、构建多元化的纠纷解决机制、维护医疗秩序和建设和谐社会等功能。建议制定《医疗责任强制保险法》确立和实行医疗责任强制保险制度,对有效解决各种医疗纠纷,深化医疗卫生体制改革,促进新时期法治社会建设将发挥重要的作用。
[Abstract]:Compulsory medical liability insurance is a liability insurance system that establishes the compulsory insurance obligations of medical institutions and medical personnel according to law in order to spread the risk of medical damage liability and compensate the losses of injured parties in time. The implementation of compulsory medical liability insurance system can protect the legitimate rights and interests of the patients, ease the contradiction between doctors and patients, transfer medical risks and raise the level of medical science and technology, promote innovation of insurance products and establish insurance market rules. Build a diversified dispute resolution mechanism, maintain medical order and build a harmonious society and other functions. It is suggested that the establishment and implementation of the compulsory medical liability insurance law will play an important role in effectively resolving various medical disputes, deepening the reform of the medical and health system and promoting the construction of a society ruled by law in the new period.
