食品安全风险预警法律机制研究

【摘要】：食品安全已经成为社会各界高度关注的焦点问题，它不仅影响公民的身体健康和生命安全，降低居民幸福指数，甚至会妨碍社会的安定和经济的健康有序发展。食品安全是世界各国共同面临的问题，频发的食品安全事件迫使监管者从单纯注重食品安全的事后救济逐步转向事前防范，以降低食品安全事件的发生频率，减轻由其带来的社会损害后果。食品安全风险预警制度正是在此背景下应运而生。我国食品安全风险预警相关法律体系系已基本成型、运行保障机制已基本建立，但是食品安全问题并没有得到解决，，食品安全隐患依然较多。笔者认为，这种情形的出现与我国食品安全风险预警法律机制起步较晚、发展不成熟有较大的关系，有必要进一步对我国食品安全风险预警法律机制进行研究和完善。本文首先分析和界定了食品安全风险预警的基本概念，明确提出什么是食品安全风险预警，并从国内外食品安全风险预警机制产生的现实背景出发，着重说明食品安全风险预警法律机制产生的必要性。紧接着运用国家干预理论、经济效益理论、系统分析理论及国际社会研究预警机制通用的风险分析理论对食品安全风险预警机制的理论基础进行分析，从理论上肯定食品安全风险预警机制。然后从我国食品安全风险预警法律体系及其运行机制的现状出发，分析总结出我国食品安全风险预警机制存在法律依据整体不足、预警具体运行环节法律制度不健全、监管机制存在弊端、社会参与机制发展不充分、责任承担机制存在漏洞等问题。最后在借鉴美国食品安全风险管理制度与欧盟食品和饲料快速预警机制的基础上对我国食品安全风险预警法律机制的完善提出以下具体建议：充实食品安全风险预警的法律依据、完善食品安全风险预警实施体系、加强食品安全风险预警的参与机制、严格食品安全风险预警责任机制。
[Abstract]:Food safety has become the focus of attention from all walks of life. It not only affects citizens' health and safety of life, reduces the index of residents' happiness, but also hinders the stability of society and the healthy and orderly development of economy. Food safety is a common problem all over the world. Frequent food safety incidents force regulators to gradually shift from merely paying attention to food safety afterwards to taking precautions in advance in order to reduce the frequency of food safety incidents. To mitigate the consequences of social damage caused by it. It is under this background that food safety risk warning system emerges as the times require. The relevant legal system of food safety risk warning in our country has been basically formed and the operational security mechanism has been basically established, but the food safety problem has not been solved, and there are still many hidden dangers of food safety. The author thinks that the emergence of this situation is related to the late start and immature development of the legal mechanism of food safety risk warning in China. It is necessary to further study and improve the legal mechanism of food safety risk early warning in China. This paper first analyzes and defines the basic concept of food safety risk warning, puts forward clearly what is food safety risk early warning, and proceeds from the realistic background of food safety risk warning mechanism at home and abroad. It emphasizes the necessity of the legal mechanism of food safety risk warning. Then the theoretical basis of food safety risk warning mechanism is analyzed by using the national intervention theory, the economic benefit theory, the systematic analysis theory and the general risk analysis theory of the international community research on the early-warning mechanism of food safety. Theoretically affirm the food safety risk warning mechanism. Then proceeding from the current situation of our country's food safety risk warning legal system and its operating mechanism, the author analyzes and summarizes that the food safety risk early warning mechanism in our country has insufficient legal basis as a whole, and the legal system of the specific operation link of the early warning is not perfect. There are defects in supervision mechanism, insufficient development of social participation mechanism and loopholes in responsibility assumption mechanism. Finally, on the basis of drawing lessons from the US food safety risk management system and the European Union food and feed rapid warning mechanism, the following specific suggestions are put forward to improve the food safety risk early warning legal mechanism in China: enrich the food safety risk The legal basis for early warning, We will improve the implementation system of food safety risk warning, strengthen the participation mechanism of food safety risk early warning, and strictly enforce the food safety risk early warning responsibility mechanism.
