反思与转变:我国城管执法理念之检视

【摘要】：近年来,我国城市管理陷入一种"城管人员暴力执法、相对人公然抗法"的恶性循环之中。究其原因,城管部门执法理念过于滞后——"秩序行政"理念、"政府主体"理念、"小城管"理念,显然难逃其咎。故此,为了构建法治城管,加强和谐城市建设,继而提高我国城市的整体治理水平,也就需要在我国城管部门的执法理念层面作出相应的转变,亦即树立"服务行政"理念、"政府主体"理念以及"大城管"理念。
[Abstract]:In recent years, urban management in our country has been caught in a vicious circle of violent law enforcement by urban management personnel and blatant resistance to the law. The reason is that the law enforcement idea of urban management department is too lagged-the idea of "order administration", "government subject" and "small chengguan" are obviously to be blamed. Therefore, in order to construct urban management by law, strengthen the construction of harmonious city, and then improve the overall governance level of Chinese cities, we need to make corresponding changes in the law enforcement concept of urban management departments in our country. That is, to establish the concept of "service administration", "government subject" and "urban management".
