我国辅警制度法律问题研究

【摘要】:我国的辅警制度,自其诞生之日起,便成为备受争议的法律焦点。辅警制度虽然弥补了在编警力不足的缺点,为维护社会稳定有序贡献了重要力量,但辅警队伍中人员身份定位存疑、缺乏法律监管等现实状况,又为社会安定和谐增添了新的问题。与此同时,在实际工作中,辅警的职能责任该如何界定,也是目前辅警制度中亟须解决的争议焦点问题之一。本文借此希望通过文献收集、整理、归纳和总结等方式,可以大致梳理出辅警制度的理论脉络,并借鉴其他国家和地区辅警制度的成功经验,为我国辅警制度的未来发展提供些许思路和建议。本文以我国辅警制度作为研究对象,首先从辅警制度的概念入手,详述我辅警制度的历史沿革、发展历程中的经验教训以及目前所存在的问题。其次,通过将域外国家和港台地区辅警制度与中国大陆地区作比对,直面我国辅警制度当前所面临的问题,汲取先进成熟辅警制度之中的宝贵经验。再次,结合我国实际国情,对我国辅警制度的相关学说和理论基础进行理论分析,为建立科学完善的辅警制度体系提供理论依据与支撑,并为我国辅警制度总结出现实与未来的理论选择。最后,依据前述理论和制度设计,从身份定位标准、制度追责机制、参与执法程序、制度监管体系等四个方面来完善和丰富我国辅警制度的结构体系。依本文愚见,辅警之辅,意味着有所为而有所不为。我国辅警制度面临的问题,是人的问题,更是体制的问题。各级辅警主管部门在招录、使用、培训、管理、考核等各个环节制度化与法治化的同时,更应着力解决辅警的主体资格、法律责任、职责权限、监督管理等体制问题。现阶段,我国理应以国务院办公厅印发的《关于规范公安机关警务辅助人员管理工作的意见》作为导向,进一步严把入口、严明纪律、落实责任和清理规范。此外,在实践过程中,还应直面问题症结之所在,树立法治思维,以理顺管理体制、明确岗位职责为核心,以完善管理制度、落实职业保障为重点,加快推进辅警人员管理实现制度化、规范化、法治化,为维护国家安全和社会稳定提供有效的人力资源保障。
[Abstract]:Since its birth, the Auxiliary Police system in China has become a controversial legal focus. Although the Auxiliary Police system has made up for the shortcomings of the insufficient number of police on the job, and has contributed an important force to the maintenance of social stability and order, the status of personnel in the auxiliary police force is doubtful, and there is a lack of legal supervision, etc. It also adds new problems to social stability and harmony. At the same time, in the actual work, how to define the functional responsibility of auxiliary police is also one of the controversial issues that need to be solved urgently in the current auxiliary police system. This paper hopes that through literature collection, collation, induction and summary, we can sort out the theoretical context of the Auxiliary Police system, and learn from the successful experiences of other countries and regions. Provide some ideas and suggestions for the future development of the auxiliary police system in our country. This article regards the auxiliary police system of our country as the research object, starts with the concept of the auxiliary police system, details the historical evolution of our auxiliary police system, the experience and lessons in the course of development and the existing problems at present. Secondly, by comparing the auxiliary police system between foreign countries, Hong Kong and Taiwan with the mainland of China, we can face up to the current problems faced by the auxiliary police system of our country, and draw valuable experience from the advanced and mature auxiliary police system. Thirdly, combined with the actual situation of our country, the theory and theoretical basis of the auxiliary police system in China are analyzed theoretically, which provides theoretical basis and support for the establishment of a scientific and perfect auxiliary police system. And summarizes the reality and the future theory choice for our country auxiliary police system. Finally, according to the above-mentioned theory and system design, from four aspects of identity positioning standard, system accountability mechanism, participation in law enforcement procedures, system supervision system to improve and enrich our auxiliary police system structure system. According to this article, the auxiliary police means something to do and not to do. The problem that our auxiliary police system faces is the problem of human being and system. The competent departments of auxiliary police at all levels should, while institutionalizing and legalizing all aspects of recruitment, use, training, management, examination, etc., should pay more attention to solving the system problems such as the subject qualification, legal responsibility, duty authority, supervision and management of the auxiliary police. At the present stage, our country should take "opinions on standardizing the Management of Police Auxiliary personnel of Public Security organs" issued by the General Office of the State Council as the guide, further strictly enforce the entrance, strictly discipline, carry out the responsibility and clean up the standard. In addition, in the process of practice, we should face the crux of the problem directly, set up the thinking of rule by law, take the management system straightened out, make clear the post responsibility as the core, improve the management system and carry out the occupational security as the emphasis. Speed up the implementation of the auxiliary police personnel management institutionalization, standardization, rule by law, for the maintenance of national security and social stability to provide effective human resources protection.
