论我国医疗紧急处置制度的完善

【摘要】：随着我国社会经济的迅速发展、人民生活水平显著改善,病患就诊量也逐年增加。但是医患双方联络关系的日益密切也引起了医患矛盾冲突的发生率提高。因医方紧急情况下侵犯患者知情同意权导致的争议也越来越多。本文通过对患者知情同意权分析及与医疗紧急处置制度之间关系,及利益思考,进行论述。对医疗紧急处置制度相关理论进行整理研究,结合我国相关立法现状,参考国内外专家学者的观点、国内外实践经验与国外立法,提出了有关我国医疗紧急处置制度完善的几点建议,以期遏制医患关系恶化、稳定医疗秩序、捍卫医患权益、和谐医患关系。第一部分阐述了医疗紧急处置制度的产生由来及其正当性依据。具体内容包含患者知情同意权概述、导致的现实困境及与医疗紧急处置制度的关系;医疗紧急处置制度的适用正当性。第二部分是对医疗紧急处置制度的立法沿革与权义结构的分析。第三部分主要是通过论述我国医疗紧急处置立法现状所存在不足之处并提出完善建议。首先,明确医疗紧急处置制度的启动条件;其次,增设医疗紧急处置措施类型;再次,完善医疗紧急处置前置、后置程序;最后,进一步明确责任分配。
[Abstract]:With the rapid development of social economy, people's living standard has been improved significantly, and the number of patients has increased year by year. However, the increasingly close relationship between doctors and patients also leads to an increase in the incidence of conflicts between doctors and patients. There are more and more disputes caused by the violation of patients' right to informed consent in medical emergency. This paper discusses the relationship between patient's informed consent right and medical emergency disposal system, as well as their benefits. Based on the relevant theories of medical emergency disposal system, combined with the current situation of relevant legislation in China, referring to the views of experts and scholars at home and abroad, the practical experience at home and abroad and foreign legislation, Some suggestions on the perfection of medical emergency disposal system in China are put forward in order to contain the deterioration of doctor-patient relationship, stabilize the medical order, safeguard the rights and interests of the doctor-patient, and harmonize the doctor-patient relationship. The first part expounds the origin of medical emergency disposal system and its legitimate basis. The specific content includes the summary of patients' informed consent right, the realistic predicament caused by it and the relationship between it and the medical emergency disposal system, and the legitimacy of the medical emergency disposal system. The second part is the analysis of the legislative evolution and the right-meaning structure of the medical emergency disposal system. The third part mainly discusses the deficiency of medical emergency disposal legislation in China and puts forward some suggestions. First, the starting conditions of the medical emergency disposal system; secondly, the addition of medical emergency treatment measures; third, improve the medical emergency disposal procedures; finally, further clarify the distribution of responsibilities.
