食品安全信息披露法律制度研究

【摘要】：近年来我国由食品安全问题引发事故频发,因此食品安全问题备受全社会的关注,食品安全问题影响广泛,容易引发公众对政府以及食品企业的信任危机。由此向公众披露食品安全信息就显得尤为重要。食品安全信息是国家制定食品安全法律政策的重要依据,同时也对保障食品市场有序建设起到重要作用。因此世界各国都把食品安全信息披露制度的建设作为重点。本文的研究内容主要分为五章,第一章绪论主要阐明了问题的起源,文章的主要思路和内容,研究意义以及所运用的研究方法。对全文的写作起了铺垫作用。第二章主要介绍食品安全信息披露机制的概述,并从经济学信息不对称以及法学角度分析这一问题。第三章对美国食品安全信息披露制度做了介绍,并与我国的制度进行对比,希望能对我国食品安全信息披露制度提供参考。第四章主要从我国目前食品安全法律规范,食品企业,政府责任三方面讨论了目前我国食品安全信息披露存在的不足。第五章对我国现行食品安全信息披露制度提出了完善的建议。我国现有食品安全信息披露体系存在很多缺陷,政府以及食品生产者在信息披露过程中缺乏统一协调能力。因此,研究政府、企业在食品安全信息披露中的责任,加强信息披露的制度建设,对于政府更好地保障人民的食品安全,治理食品安全问题具有重要的现实意义。
[Abstract]:In recent years, accidents caused by food safety problems occur frequently in our country. Therefore, food safety problems have attracted the attention of the whole society. Food safety problems have a wide impact on the government and food enterprises, which can easily lead to the crisis of public trust to the government and food enterprises. Therefore, it is particularly important to disclose food safety information to the public. Food safety information is an important basis for the formulation of food safety laws and policies, and also plays an important role in ensuring the orderly construction of food market. Therefore, countries all over the world to food safety information disclosure system as the focus. The main contents of this paper are divided into five chapters. The first chapter introduces the origin of the problem, the main ideas and contents of the article, the significance of the research and the research methods used. The full text of the writing played a role in paving the way. The second chapter mainly introduces the overview of food safety information disclosure mechanism, and analyzes this problem from the angle of economic information asymmetry and law. The third chapter introduces the food safety information disclosure system in the United States, and compares it with the system of our country, hoping to provide reference for the food safety information disclosure system in our country. The fourth chapter mainly discusses the shortcomings of food safety information disclosure in China from the following three aspects: food safety legal norms, food enterprises and government responsibility. The fifth chapter puts forward the perfect suggestion to the current food safety information disclosure system of our country. There are many defects in the current food safety information disclosure system in China, and the government and food producers lack the unified coordination ability in the process of information disclosure. Therefore, it is of great practical significance for the government to study the responsibility of government and enterprises in food safety information disclosure and to strengthen the construction of information disclosure system for the government to better protect the food safety of the people and to deal with the food safety problems.
