中日社会体育基本法律制度的比较研究

【摘要】：随着我国经济的迅猛发展，人民的物质生活水平不断提高，大众对健康和幸福的追求日益提高，呈现出体育健身化、社会化的趋势，这使得社会体育得到了更快的发展；但社会体育要想取得更高质量的发展，，就必须有完善的法律制度做保障。近代以来，日本的法律制度作为大陆法系的典型代表为我国法律制度的完善提供了宝贵的经验。深入、系统地研究日本社会体育法律制度，从历史之维理解它的生命，从理念之维解读它的精神，从制度之维发掘它的机制，从理论之维分析它的义理，对于当代我国合理地借鉴日本社会体育法律制度，具有重要的价值。全文共分为七个部分: 第一部分：社会体育及其基本法律制度概述。第二部分：中日社会体育的法律地位。依据法律效力的层级，对比、分析了社会体育在两国体育法体系中的法律地位。第三部分：中日社会体育的组织与管理。从法学角度对社会体育组织与管理的机构按权利层级进行对比研究。第四部分：中日社会体育全民健身法律制度。分析了中国的《全民健身条例》、《全民健身计划》、《体育事业发展“十二五”规划》和日本的《体育立国战略》、《体育基本计划》。第五部分：中日社会体育指导员制度。对比分析了两国社会体育指导员的分类、制度、内容等。第六部分：中日国民体质监测制度。对比分析了两国国民体质的监测制度，主要包括中国的《国民体质测定标准施行办法》、《国民体质监测工作规定》和日本的国民《新体力测试》、运动适应能力体力测试。第七部分：结论与建议。在前文分析的基础上，对中日社会体育的基本法律制度进行总结，并给出建议。
[Abstract]:With the rapid development of our country's economy, the people's material living standard is improving constantly, and the public's pursuit of health and happiness is improving day by day, showing the trend of fitness and socialization of sports, which makes the social sports develop more quickly. However, if social sports want to achieve higher quality development, it must have a sound legal system to ensure. Since modern times, Japan's legal system, as a typical representative of the continental law system, has provided valuable experience for the perfection of China's legal system. Deeply and systematically studies the Japanese social sports legal system, understands its life from the historical dimension, interprets its spirit from the concept dimension, excavates its mechanism from the system dimension, analyzes its justice from the theoretical dimension. It is of great value for our country to use Japanese social sports law system for reference. The full text is divided into seven parts: the first part: social sports and its basic legal system. The second part: the legal status of Sino-Japanese social sports. According to the level of legal effect, this paper analyzes the legal status of social sports in the sports law system of the two countries. The third part: the organization and management of social sports in China and Japan. From the point of view of law, this paper makes a comparative study on the social sports organization and management according to the level of rights. The fourth part: the legal system of national fitness of Chinese and Japanese social sports. The regulations of National Fitness for all in China, the National Fitness Plan, the 12th Five-Year Plan for the Development of physical Education, the National Strategy for Sports in Japan and the basic Plan for physical Education are analyzed in this paper. The fifth part: the social sports instructor system of China and Japan. The classification, system and content of social sports instructors in the two countries are compared and analyzed. The sixth part: Chinese and Japanese national physique monitoring system. The national physique monitoring system of the two countries was compared and analyzed, including the implementation of the National physique Measurement Standard in China, the National physique Monitoring regulations, and the Japanese National New physical Fitness Test, and the physical fitness test of the exercise adaptability. Part VII: conclusions and recommendations. On the basis of the above analysis, this paper summarizes the basic legal system of social sports between China and Japan, and gives some suggestions.
