我国有机食品的立法研究

【摘要】:随着食品安全事故的频发,环境污染事件的不断爆发,传统的食品受到质疑,有机食品倍受亲睐。有机食品不仅顺应了人们生活的需求,而且促进了生态环境的改善和环境污染的治理,最重要的是顺应了十八大提出的“生态文明”理念,有机食品可谓对人类至关重要。建立良好的有机食品市场,不仅需要政府政策的倡导,更需要法律的规制。有机食品法律制度是发展有机食品良好的市场秩序必不可少的法律保障,它有利于有机食品生产企业的良性发展,有助于解决有机食品目前存在的混乱状况,并且规范严苛的法律标准更是我国有机食品出口的良好途径。 本文顺应可持续发展理念和生态文明理念,旨在构想一部适合中国国情发展的有机食品法律制度。第一部分是我国有机食品相关法律法规的现状及问题,主要阐述了目前我国有机食品相关的法律法规,主要包括《有机产品认证管理办法》、《有机产品认证实施规则》、《中华人民共和国认证认可条例》、《食品安全法》等,并且指出了我国有机食品存在的问题,缺乏一部统一指导的有机食品法律以及有机食品的标准亟需规范。第二部分是国外有机食品立法的先进做法,美国的《有机食品生产法案》、日本的《有机JAS法》、欧盟地区的《新有机农业法》和巴西的《有机生产法》都为我国制定有机食品法提供了可靠的借鉴及指导。第三部分是建立我国有机食品立法的必要性与可行性分析,我国环境立法速度、有机食品生产企业的发展、有机食品消费市场的混乱、国外进口严苛标准的有机食品等都是建立我国有机食品法律的必要性,本文也从不同的角度分析了我国建立有机食品立法的可行性。第四部分是建立我国有机食品立法的构想,本文从生产、加工、销售方面,认证许可、标识方面,进口方面以及法律责任四个方面入手,具体阐述了对我国建立有机食品立法的构想。 有机食品的立法是一个长期的过程,需要各方面的共同努力,本文试图从我国目前的法律法规出发,,吸收借鉴国外先进经验的基础上,分析建立我国有机食品立法的框架与结构,希望能为推动我国有机食品的立法做出一点力量。
[Abstract]:With the frequent occurrence of food safety accidents and environmental pollution incidents, the traditional food is questioned and organic food is popular. Organic food not only conforms to the needs of people's life, but also promotes the improvement of ecological environment and the treatment of environmental pollution. The most important thing is to comply with the concept of "ecological civilization" put forward by the 18th National Congress of the CPC. Organic food is of great importance to human beings. The establishment of a good organic food market requires not only government policy advocacy, but also legal regulation. The legal system of organic food is an indispensable legal guarantee for the development of a good market order for organic food. It is conducive to the healthy development of organic food production enterprises and helps to solve the confusion existing in organic food at present. And standardizing strict legal standard is a good way to export organic food in our country. In accordance with the concept of sustainable development and ecological civilization, this paper aims to conceive an organic food legal system suitable for the development of China's national conditions. The first part is the current situation and problems of organic food related laws and regulations in China. It mainly includes the Organic Product Certification Management measures, the Organic Product Certification implementation rules, the people's Republic of China Certification and Accreditation regulations, the Food Safety Law, etc., and points out the existing problems of organic food in China. The lack of a unified organic food law and organic food standards need to be standardized. The second part is the advanced practices of foreign organic food legislation. The Organic Food production Act in the United States, the Organic JAS Act in Japan, the New Organic Agriculture Act in the European Union and the Organic production Act in Brazil all provide reliable reference and guidance for China to formulate organic food laws. The third part is the necessity and feasibility analysis of establishing organic food legislation in China, the speed of environmental legislation in China, the development of organic food production enterprises, the chaos of organic food consumption market. It is necessary to establish organic food law in our country by importing strict standard organic food from abroad. This paper also analyzes the feasibility of establishing organic food legislation in China from different angles. The fourth part is to establish the concept of organic food legislation in China. This paper starts with four aspects: production, processing, marketing, certification, marking, import and legal responsibility. The conception of establishing organic food legislation in China is expounded in detail. The legislation of organic food is a long-term process, which requires the joint efforts of all sides. This paper attempts to draw on the advanced experience of foreign countries on the basis of the current laws and regulations of our country. This paper analyzes the framework and structure of organic food legislation in China, hoping to make some efforts to promote the organic food legislation in China.
