我国移动医疗法律监管问题研究

【摘要】：移动通信技术和医疗信息化催生移动医疗的兴起,移动医疗是移动通信技术与医疗技术相融合的新兴产物,突破了医疗服务在时间和地域上的限制,一定程度上缓解了医疗领域“看病难、看病贵”的问题。移动医疗发展前景十分广阔,但在发展过程中,包括美国在内的发达国家也面临着诸多法律问题,我国法律发展的滞后性导致移动医疗监管领域的法律问题尤为突出。文章从法治视角厘清了我国移动医疗发展的情况以及立法现状,明确了我国目前移动医疗除法律法规不健全外,存在的准入门槛、技术稳定、虚假广告和医疗安全性以及个人信息保护中的问题。参照美国经验并结合我国实际情况,建议我国移动医疗在监管上需要完善法律法规,明确监管机构、监管权限、监管程序,建立移动医疗分级监管模式,同时要充分发挥社会舆论监督作用,建立畅通的社会监督反馈渠道。
[Abstract]:Mobile communication technology and medical information bring about the rise of mobile medical treatment. Mobile medical is a new product of mobile communication technology and medical technology. It breaks through the limitation of medical service in time and region, to some extent alleviates the problem of "difficult to see and expensive" in medical field. The prospect of mobile medical development is very broad. But in the process of development, the developed countries, including the United States, also face a number of legal problems. The lagging of the development of China's law leads to the legal problems in the field of mobile medical supervision. The article clarifies the situation of mobile medical development and the legislative status of China from the Perspective of the rule of law, and clarifies the law of mobile medical treatment in China at present. The barriers to access, technical stability, false advertising and medical safety and personal information protection are problems. According to the experience of the United States and the actual situation in China, it is suggested that China's mobile medical care should improve the laws and regulations in supervision and regulation, clear the regulatory framework, regulatory authority, regulatory procedures, and establish mobile medical classification. At the same time, we should give full play to the role of public opinion supervision and set up an unimpeded channel for social supervision and feedback.
