“十二五”期间食品药品监管行政复议统计数据分析

【摘要】：目的通过详实的数据分析剖析食品药品监管系统行政能力现状,为提升食品药品监管系统依法行政能力献计献策。方法以"十二五"期间食品药品监管总局《食品药品监督管理统计年报》数据为研究对象,结合我国行政复议相关法律法规,食品药品监管总局《国家食品药品监督管理总局行政复议办法》、《关于全面加强食品药品监管系统法治建设的实施意见》等部门规章,对我国食品药品监管行政复议数量、类别、地域等进行分析。结果与结论 "十二五"期间,全国食品药品监管行政复议年受理量从104件猛增至4 331件,食品行政复议以6 343件占比达78.5%,行政复议数量呈显著地区差异,广东以2 045件占据榜首,新疆生产建设兵团和西藏仅1件。"十二五"期间共做出4 500个行政复议决定,其中驳回申请1 007件,维持原行政行为2 480件。由此可见,我国食品药品监管行政复议数量急剧增加,食品药品监管系统任务繁重,基层法制工作力量和能力相对不足,行政复议数量与经济活跃程度相关,行政复议推动了规范执法。建议加强法制力量建设,提升工作人员法律素养,加强依法行政考核。
[Abstract]:Objective to analyze the present situation of administration ability of food and drug supervision system through detailed data analysis, and to offer suggestions for improving the administration ability of food and drug supervision system according to law. Methods the data of the Statistical Annual report of Food and Drug Supervision and Administration of the General Administration of Food and Drug Administration during the 12th Five-Year Plan period were taken as the research object, and the relevant laws and regulations of administrative reconsideration in China were combined. The administrative reconsideration measures of the State Food and Drug Administration of the State Administration of Food and Drug Supervision and Administration, the implementation opinions on strengthening the Construction of the Food and Drug Supervision system under the Rule of Law in an All-round way, and other departmental rules and regulations, the number and category of administrative reconsideration of food and drug supervision and control in China, Make an analysis of the region, etc. Results and conclusion during the 12th Five-Year Plan the annual acceptance of administrative review of food and drug supervision increased from 104 cases to 4 331 cases and 6 343 cases accounted for 78.5% of Prida. There were significant regional differences in the number of administrative reviews. Guangdong topped the list with 2,045 pieces, while the Xinjiang production and Construction Corps and Tibet had only one. " During the 12th Five-Year Plan, 4,500 administrative reconsideration decisions were made, of which 1,007 applications were rejected and 2,480 administrative acts were maintained. It can be seen from this that the number of administrative reviews of food and drug supervision in China has increased dramatically, that the food and drug regulatory system has a heavy task, that the legal system at the grassroots level is relatively inadequate in strength and ability, and that the number of administrative reviews is related to the degree of economic activity. Administrative reconsideration promoted the standardization of law enforcement. It is suggested to strengthen the construction of legal power, enhance the legal literacy of staff, and strengthen the examination of administration according to law.
