【摘要】：近年来,随着老年人口比重的不断增加,我国的老龄化进程显著加快。根据国家统计局的数据显示,1999年我国已正式迈入老龄化国家的行列,成为世界上老年人口数量最多的国家。如何解决养老问题不仅是我国社会发展的现实需要,也是重大的理论课题。随着国家政策的导向,民间资本大量涌入养老服务领域,出现了营利性和非营利性两种不同性质的养老机构。由于我国的养老服务产业起步较晚,除了硬件设施建设远不能满足现实需要,市场运营也存在着许多不完善的地方。可以肯定,伴随着老龄化高峰的到来,高质量的养老服务需求将进一步催生营利性养老机构的产生。养老服务具有特殊的社会功能和道德价值,为了确保营利性养老机构的行为符合法律的规定和道德的要求,必须对营利性养老机构的进入、经营、退出进行监管,以促进营利性养老服务产业健康有序发展。本文共分为四个部分：第一部分主要对营利性养老机构监管法律制度研究涉及的基础理论问题进行阐释,为全文提供理论铺垫,包括营利性养老机构、营利性养老机构监管的概念、内容等,其目的在于对全文基础性概念作理论分析,同时说明加强营利性养老机构监管的必要性。第二部分介绍我国营利性养老机构准入制度的监管。通过对设立条件、设立审批、设立登记等程序的分析,提出营利性养老机构由于享受着国家政策福利、关系着社会公共利益,因此需要建立适合于营利性养老机构的准入规定。第三部分主要介绍我国营利性养老机构的运营监管。由于种种原因,我国尚未建立起立体式的监管系统,因此需要建立起多元化、多维度的立体监管模式,保障营利性养老机构和谐稳定发展。第四部分介绍我国营利性养老机构的退出监管制度。主要对退出申报制度、退出清算制度进行分析,对已有的制度加以梳理,同时建议政府建立有关我国营利性养老机构的善后处理制度,以挽救频临破产的养老机构,维护老年服务消费者合法权益。
[Abstract]:In recent years, with the increasing proportion of the elderly population, the aging process in China has been accelerated significantly. According to the data of the National Bureau of Statistics, in 1999, China has formally stepped into the ranks of aging countries, becoming the largest number of elderly people in the world. How to solve the pension problem is not only the realistic need of our social development, but also an important theoretical subject. With the guidance of national policies, private capital flows into the field of pension services, and there are two different types of pension institutions: for-profit and non-profit. Due to the late start of the old-age service industry in China, the construction of hardware facilities is far from satisfying the actual needs, and there are many imperfections in the market operation. It is certain that with the arrival of the aging peak, the demand for high-quality pension services will further promote the generation of for-profit pension institutions. Pension service has special social function and moral value. In order to ensure that the behavior of profit-making pension institutions conforms to the provisions of law and moral requirements, it is necessary to supervise the entry, operation and withdrawal of for-profit pension institutions. In order to promote the healthy and orderly development of profit pension service industry. This paper is divided into four parts: the first part mainly explains the basic theoretical issues involved in the study of the legal system of supervision of for-profit pension institutions, and provides a theoretical basis for the full text, including for-profit pension institutions. The purpose of this paper is to make a theoretical analysis of the basic concepts of the for-profit pension institutions, and at the same time to explain the necessity of strengthening the supervision of for-profit pension institutions. The second part introduces the supervision of the admission system of the profit-making pension institutions in China. Based on the analysis of the establishment conditions, examination and approval, registration and other procedures, it is proposed that the for-profit pension institutions need to establish the admission regulations suitable for the profit pension institutions because they enjoy the welfare of the state policy and are related to the social and public interests. The third part mainly introduces the operation and supervision of the profit-making pension institutions in China. Due to various reasons, China has not yet established a three-dimensional regulatory system, so it is necessary to establish a diversified, multi-dimensional three-dimensional supervision model to ensure the harmonious and stable development of for-profit pension institutions. The fourth part introduces the withdrawal supervision system of profit-making pension institutions in China. It mainly analyzes the withdrawal declaration system and the exit liquidation system, combs the existing system, and suggests that the government establish a post-treatment system for the for-profit pension institutions in China in order to save the pension institutions that are on the verge of bankruptcy. To safeguard the legal rights and interests of elderly service consumers.
