清朝宗教事务法律治理的历史智慧及当下镜鉴

【摘要】：当下的宗教事务法律治理需要回采历史、以史鉴今。在传统社会中,清代宗教事务的法律治理取得了较好效果。清朝重视宗教的政治功能和社会功能,注重宗教立法,注重因地制宜、因教制宜的多元治理策略,针对不同的民族、不同宗教给予区别对待,一定意义上体现了宗教宽容。但也注意护持正教、黜邪崇正,对邪教及宗教犯罪严加打击。清政府将宗教事务纳入行政管理体制,既设立了礼部、理藩院等中央机构,还设立分级的宗教管理机构,对宗教人员的认定资格、教徒登记、宗教场所、宗教人员行为规范、宗教人员犯罪的处罚都从法律上做了具体规定。清朝宗教事务法律治理的立法宗旨及具体措施值得当下适度借鉴。
[Abstract]:In the traditional society, the legal governance of religious affairs in the Qing Dynasty has achieved good results. The Qing Dynasty attaches great importance to the political and social functions of religion in the traditional society. The Qing government has incorporated the religious affairs into the administrative system, which has set up the central institutions of the rites, the academy and other central institutions, and also sets up a hierarchical religious management institution for the identification of religious personnel and the boarding of the believers. The religious places, the norms of the behavior of the religious personnel and the punishment of the criminal offense of the religious personnel have been stipulated in the law. The legislative purpose and concrete measures of the legal governance of the religious affairs of the Qing Dynasty should be used for reference at the moment.
