网络虚拟社会的法律治理问题探讨

【摘要】：网络的快速发展应用,在带给人们生活便利的同时,也导致网络安全及犯罪问题频发。因此,亟需进行顶层法律规制设计,统筹规划网络社会的司法实践活动。主要包括:在加强和规范网络传播秩序方面,需要政府及各相关部门协作互动,加强传播秩序立法,以整治网络虚假新闻,规范网络新闻传播秩序;在加强网络传播内容立法方面,要注意调整网络社会中涉及公权力网络公法、调整私权利法律关系的网络私法以及针对技术应用标准的网络技术性法律规范;在规范网络传播行为方面,网络立法的过程中要考虑建立起网络主客体"为我而存在"关系的价值联系及其实践基础,推行网络实名制,确立正确的利益引导机制。
[Abstract]:The rapid development and application of network not only bring convenience to people's life, but also lead to frequent network security and crime problems. Therefore, it is urgent to design the top-level legal regulation and plan the judicial practice in the network society as a whole. The main contents are as follows: in order to strengthen and standardize the order of network communication, it is necessary for the government and the relevant departments to cooperate and interact to strengthen the legislation of communication order in order to regulate the network false news and standardize the order of network news dissemination; In the aspect of strengthening the legislation of network communication content, we should pay attention to adjusting the network private law involving public power and network public law, adjusting the legal relation of private right and the network technical legal norm aiming at the technical application standard in the network society; In the aspect of standardizing the behavior of network communication, in the course of network legislation, we should consider establishing the value connection and practical foundation of the relationship between the subject and object of the network "exist for me", carry out the system of network real name, and establish the correct benefit guiding mechanism.
