南宁市食品生产加工小作坊食品安全监管调研报告

【摘要】:从我国食品安全监管水平来看,目前我国对食品生产加工小作坊(以下简称“小作坊”或南宁市小作坊)的食品安全监管制度与措施是相对缺乏、空白的,远远落后于现实状况。面对法律上的空白与无力,面对猖獗肆虐的食品安全事件,小作坊作为食品安全问题的多发点和监管的难点不得不引起重视,为此有必要提出行之有效的解决方案。本调研报告旨在通过对南宁市的小作坊展开深入的调研工作,通过调研过程了解南宁市小作坊的食品安全监管现状,从而发现其存在的监管上的法律问题,最终目的是形成调研报告,在立法上、执法上为小作坊的食品安全监管提出合理有效的解决建议。 第一部分部分是对调研报告进行了总体的概述。第二部分中笔者简单地通过对南宁市小作坊的基本情况进行调查,指出其本身所具有的特点和存在的问题。 第三部分中笔者着重地对小作坊的食品安全监管情况进行调研,总体上以监管制度的演变为出发点,进而了解南宁市小作坊的食品安全监管现状,通过调查问卷以及数据分析对南宁市小作坊的食品安全监管存在的法律问题进行分析。 第四部分中笔者将从所分析出的问题入手,从立法上以及执法上对完善小作坊的食品安全监管提出合理有效的建议。对小作坊在立法监管中的建议主要包括:明确小作坊的定义、建立小作坊自有的生产许可制度、限制食品生产范围与销售地域范围、完善小作坊的食品检验体系以及规定宽严相济的法律责任。在执法监管中的建议则是:构建小作坊的食品安全监管网络、严格实施日常监督检查手段,加大打击力度。
[Abstract]:Judging from the level of food safety supervision in our country, at present, the food safety supervision system and measures of the small workshops for food production and processing (hereinafter referred to as "small workshops" or small workshops in Nanning City) in our country are relatively lacking and blank. Far behind the reality. In the face of the blank and powerlessness of law and the rampant food safety incidents, small workshops, as the frequent point of food safety problems and the difficulty of supervision, have to be paid attention to, so it is necessary to put forward effective solutions. The purpose of this research report is to explore the current situation of food safety supervision in small workshops in Nanning through the investigation and research process, and to find out the legal problems in the supervision of the small workshops in Nanning. The final purpose is to form a research report and to put forward reasonable and effective suggestions for the supervision of food safety in small workshops in legislation and law enforcement. The first part is a general overview of the research report. In the second part, the author simply investigates the basic situation of Nanning small workshop and points out its own characteristics and existing problems. In the third part, the author focuses on the investigation of food safety supervision in small workshops, and generally takes the evolution of supervision system as the starting point, and then understands the current situation of food safety supervision in small workshops in Nanning. The legal problems of food safety supervision in small workshops in Nanning were analyzed by questionnaire and data analysis. In the fourth part, the author will analyze the problems from the point of view of legislation and law enforcement to improve the food safety supervision of small workshops put forward reasonable and effective suggestions. The suggestions on the legislative supervision of the small workshops include: defining the small workshops, establishing the production license system of the small workshops, limiting the food production range and the regional scope of sales. Improve the food inspection system of small workshops and provide for lenient and strict legal responsibility. The suggestions in law enforcement and supervision are to establish a food safety supervision network for small workshops, strictly implement routine supervision and inspection measures, and step up the crackdown.
