政府信息公开原则与公开限制

【摘要】：政府信息公开应当遵循知情权保障原则、最大公开原则和权利合理限制原则,对于涉及国家安全和国家秘密的信息、涉及商业秘密和个人隐私的信息、行政过程信息等各种信息公开的"公开例外"或"可不予公开"的情形,应予以必要的限制,并通过正当行政程序保障当事人的合法权利。应根据公共行政实践和行政法治的发展,不断完善政府信息公开制度。
[Abstract]:The disclosure of government information shall follow the principle of safeguarding the right to know, the principle of maximum disclosure and the principle of reasonable restriction of rights. For information involving state security and state secrets, information involving commercial secrets and personal privacy, The situation of "open exception" or "not open" of various kinds of information, such as administrative process information, should be restricted, and the legitimate rights of the parties should be guaranteed through proper administrative procedure. According to the development of public administration practice and administrative rule of law, the system of government information disclosure should be improved continuously.
