镇级政府行政执法中的现存问题及对策

【摘要】：镇级政府行政执法是指镇(乡、街道办)一级基层政府,依照法律、法规的规定,行使包括行政检查监督权、行政许可权、行政征收权等在内的行政处理权,对行政相对人的权利与义务产生实际影响的具体行政行为。目前镇级政府行政执法改革的进程缓慢,在全国一些省份如：浙江省、广东省及市正在探索在城市中心镇进行镇级政府执法改革试点工作,理论上讲镇级政府执法机能的健全会更有利于基层镇级政府开展行政执法监督检查工作,更有利于基层社会的稳定和社会的有序发展,更有利于保障社会公众的合法权益。本文着眼于分析当前镇级政府在行政执法工作方面所面临的困境,明确了基层镇级政府行政执法的基本内涵及行政执法目标,通过实证研究和比较分析,对镇级政府行政执法的现状进行了有效梳理,初步总结了现阶段所取得的成效及存在的不足,并且对如何破解当前镇级政府行政执法中存在的问题,提出了解决问题的对策。第一部分：绪论首要是发现问题,随着我国依法治国的步伐不断向前推进,指出在行政单位最末端的基层镇级政府,在行政执法领域中存在有法不依、执法不严的现象,当前随着城镇化进程不断向前推进,现实表明对镇级政府行政执法的研究不可以停止,基层镇级政府行政执法问题应引起足够的重视。第二部分：首要对镇级政府行政执法的概念进行了理论界定,目的是为了将镇级政府的行政管理行为与行政执法行为作一个概念上的明确区分,然后以广东省佛山市顺德区均安镇、勒流街道为例,重点阐述了当前基层镇级政府在行政执法工作方面的现状及其存在的问题,并有针对性的对问题进行总结归纳,进而凸出解决问题的必要性和紧迫性。第三部分：重点对镇级政府行政执法中存在的问题展开了原因剖析,通过对镇级政府行政执法现存问题的原因分析,指出当前镇级政府出现行政执法问题的缘由,从而为有效解决镇级政府行政执法问题提供正确方向。第四部分：提出解决问题的几点对策思考,从大的宏观方面及小的微观方面提出解决问题的对策,为有效解决镇级政府行政执法中的现存问题提供参考,力求使镇级政府行政执法实现新的跨越
[Abstract]:Administrative law enforcement by township governments refers to the administrative handling power of the township (township, street office) grass-roots government, which, in accordance with the provisions of laws and regulations, exercises administrative powers of supervision, administrative licensing, and administrative expropriation, etc. Specific administrative acts that have a practical impact on the rights and obligations of administrative counterparts. At present, the process of the reform of administrative law enforcement at the township level is slow. In some provinces across the country, such as Zhejiang Province, Guangdong Province and cities, the pilot work of law enforcement reform at the township level is being explored in the urban center towns. Theoretically speaking, the perfection of the law enforcement function of the township government will be more conducive to the development of administrative law enforcement supervision and inspection by the grass-roots township government, to the stability of the grass-roots society and the orderly development of the society, and to the protection of the legitimate rights and interests of the public. This paper focuses on the analysis of the difficulties faced by township governments in the field of administrative law enforcement, clarifies the basic connotation and objectives of administrative law enforcement of grass-roots township governments, and through empirical research and comparative analysis, This paper reviews the current situation of township government administrative law enforcement, summarizes the achievements and shortcomings of the present stage, and puts forward some countermeasures to solve the problems existing in the current township government administrative law enforcement. The first part: the introduction is mainly to discover the problem. With the pace of ruling the country according to law in our country, it is pointed out that in the field of administrative law enforcement, there is a phenomenon that the law is not obeyed and the law is not strictly enforced at the grass-roots township level government at the end of the administrative unit. At present, with the development of urbanization, the reality shows that the research on administrative law enforcement of township government can not be stopped, and the administrative law enforcement problem of grass-roots township government should be paid enough attention to. The second part: first of all, the concept of township government administrative law enforcement is theoretically defined, in order to make a clear distinction between the township government administrative management behavior and administrative law enforcement behavior. Then, taking the town of Jun'an, Shunde District, Foshan City, Guangdong Province as an example, the paper focuses on the current situation and existing problems of the grass-roots township government in the field of administrative law enforcement, and sums up and summarizes the problems. Then the necessity and urgency of solving the problem are highlighted. The third part focuses on the analysis of the reasons for the problems existing in the administrative law enforcement of the township government, and points out the reasons for the problems existing in the administrative law enforcement of the township government through the analysis of the existing problems in the administrative enforcement of the law at the township level. So as to effectively solve the township level government administrative law enforcement problems to provide the correct direction. Part IV: put forward some countermeasures to solve the problem, from the macro and micro aspects of the solution to the problem, to effectively solve the existing problems in the township government administrative law enforcement to provide a reference.
