福建省医师多点执业法律规制研究

【摘要】：研究目的:医师多点执业作为我国医疗体制改革中的一项重要内容,对于推动不同地区之间、不同医疗机构之间卫生人才的合理流动、医疗资源的合理配置具有重大意义。自医师多点执业提出以来,全国多个省份先后在不同程度上对医师多点执业进行了探索以及试点,然而效果并不尽如人意,医师多点执业受到了"冷遇"。因此,本文将以医师多点执业作为研究对象,研究影响医师多点执业发展的原因,通过分析这些原因,结合福建省的医疗情况,从法律的高度讨论医师多点执业的相关问题,并有针对性地提出对策和建议。研究方法:本论文主要采用借助学校图书馆以及网络数据库的文献搜集整理、实地数据考察以及比较域内域外医师执业模式相结合的研究方法,对医师多点执业提出的背景、发展前景、其中存在的法律问题等方面进行研究。论文结合福建省的医疗情况,从中国医师多点执业现状及法规溯源、现行医师执业法规以及其中存在的问题出发,论证医师多点执业的可行性、必要性和意义。通过分析各省医师多点执业的探索和实践,从法律和事实角度讨论该项政策在实施中可能存在的问题,并针对这些问题提出相应的解决方法。通过分析福建医师施行的多点执业举措,结合国外的医师执业模式,对完善福建省医师多点执业进行思考,提出福建省医师多点执业过程中应当遵循的原则、保障措施和具体建议。最后总结了开展医师多点执业工作对福建省医疗卫生事业健康发展具有重要意义,开展医师多点执业需要以法律作后盾。研究结果:本文通过研究福建省医师多点执业的相关内容,创新性的提出了在制定医师多点执业相关法律的过程中应该遵循的五大原则,并且提出了在多点执业准入中引入申请评分表用以评估医师及医疗机构情况、强化医师行业协会的具体职能等。研究结论:推广医师多点执业需要完善相关法律法规,细化多点执业管理办法,让医师多点执业行为有法可依,并将医师多点执业的行为纳入到政府的严格监管之中,以确保医师多点执业为人民带来便利的同时保障医疗安全。
[Abstract]:Objective: as an important part of the reform of medical system in China, multi-point medical practice is of great significance in promoting the rational flow of health personnel and the rational allocation of medical resources among different regions and medical institutions. Since the multi-point practice of doctors was put forward, many provinces in China have explored and experimented with the practice of doctors in different degrees. However, the effect is not satisfactory, and the practice of multi-point doctors has been treated with "cold reception". Therefore, this article will take doctors' multi-practice as the research object, study the reasons that affect the development of doctors' multi-practice, through the analysis of these reasons, combined with the medical situation in Fujian Province, from the perspective of the law to discuss the related problems of doctors' multi-practice. And puts forward the countermeasure and the suggestion pertinently. Research methods: this paper mainly adopts the research method of combining the literature collection and collation of the school library and the network database, the field data investigation and the practice pattern of doctors in and out of the region, and puts forward the background of the multi-point practice of doctors. The prospect of development, including the existence of legal problems and other aspects of research. Based on the medical situation of Fujian Province, this paper discusses the feasibility, necessity and significance of doctors' multi-point practice from the source of the status quo and regulations of multi-point practice of physicians in China, the current laws and regulations of doctors' practice and the problems existing therein. By analyzing the exploration and practice of multi-point practice of doctors in various provinces, this paper discusses the possible problems in the implementation of this policy from the point of view of law and fact, and puts forward corresponding solutions to these problems. Based on the analysis of the multi-point practice measures carried out by doctors in Fujian Province and the practice mode of doctors abroad, the author thinks about how to improve the practice of doctors in Fujian Province, and puts forward the principles that should be followed in the process of doctors' multi-point practice in Fujian Province. Safeguards and specific recommendations. In the end, the author summarizes the importance of doctors' multi-point practice to the healthy development of medical and health care in Fujian Province, which needs to be supported by law. Research results: by studying the relevant contents of multi-point practice of doctors in Fujian Province, this paper creatively puts forward five principles that should be followed in the process of formulating the law of doctors' practice of multi-point practice. In addition, the paper introduces the application score form to evaluate the situation of doctors and medical institutions, and to strengthen the specific functions of doctors' professional associations. Research conclusion: it is necessary to perfect the relevant laws and regulations, to refine the management methods of multi-point practice, to make the practice of multi-practice of doctors have legal basis, and to bring the practice of multi-practice of doctors into the strict supervision of the government.
