【摘要】：农业用水权转让是一种特殊的新型民事行为,是公法与私法相互渗透下的环境保护领域内的新型管理手段。农业用水权转让行为不仅具有传统民事行为的一般特征,同时又突破了意思自治、合同相对性、物权法定等基本理论。我国目前对农业用水权转让的理论研究尚处于起始阶段,正在摸索过程中。而我国的现行立法都没有关于农业用水权转让的明确规定,只是散见于一些地方性法规中,远远无法满足实践发展的需求。本文就是针对农业用水权转让在理论认识上的模糊和在实践中遇到的问题,对农业用水权转让制度进行深入的理论分析与探讨。第一章主要对农业用水权转让制度的基本理论进行阐述,通过对水权的概念分析从而引入农业用水权这一具体水权。本章首先是对水权、农业用水权的内涵进行分析概括。其次是对农业用水权转让行为进行理论定性。最后,结合我国农业用水权成功转让的案例分析其产生的现实效果。第二章重点分析了我国农业用水权转让制度存在的主要问题,为我国农业用水权转让制度的完善提供思路。本章的第一节首先从我国的法律制度方面说明关于农业用水权转让的法律体系不完整。第二节对农业用水权权属的界定问题进行分析。第三节是对农业用水权配置制度的探讨。第四节分析农业用水权交易市场转让机制中存在的问题。第五节则阐述了农业用水权市场的转让信息不对称的原因。第六节主要分析政府在农业用水权转让过程中的角色定位问题。第三章是本文的重点内容,在前面两章分析的基础上,针对农业用水权转让过程中存在的问题,为我国农业用水权转让制度的完善提供建议。从我国国情出发研究农业用水权转让制度,为我国特色社会主义农业用水权转让制度建设提供参考。
[Abstract]:The transfer of agricultural water right is a special new civil act and a new management method in the field of environmental protection under the mutual penetration of public and private law. The transfer of agricultural water right not only has the general characteristics of traditional civil behavior, but also breaks through the basic theories such as autonomy of will, relativity of contract, law of real right and so on. At present, the theoretical study on the transfer of agricultural water rights in China is still in the initial stage and is in the process of exploration. But the current legislation of our country does not have the explicit stipulation about the agricultural water right transfer, only scattered in some local laws and regulations, far can not meet the demand of the practice development. In view of the ambiguity in theory and the problems encountered in practice, this paper makes a deep theoretical analysis and discussion on the transfer system of agricultural water use right. The first chapter mainly expounds the basic theory of agricultural water right transfer system, through the analysis of the concept of water right, it introduces the agricultural water right as a specific water right. This chapter firstly analyzes and generalizes the connotation of water right and agricultural water right. Secondly, the transfer of agricultural water rights is theoretically qualitative. Finally, the paper analyzes the practical effect of the successful transfer of agricultural water rights in China. The second chapter focuses on the analysis of the main problems existing in the transfer system of agricultural water rights in China, and provides ideas for the improvement of the transfer system of agricultural water rights in China. The first section of this chapter first explains the incomplete legal system of agricultural water right transfer from the legal system of our country. The second section analyzes the definition of the right to agricultural water use. The third section discusses the allocation system of agricultural water right. The fourth section analyzes the problems existing in the transfer mechanism of agricultural water right trading market. The fifth section expounds the reason why the transfer information of agricultural water right market is asymmetric. The sixth section mainly analyzes the role of the government in the process of agricultural water rights transfer. The third chapter is the key content of this paper, based on the analysis of the previous two chapters, in view of the problems existing in the process of agricultural water rights transfer, to provide suggestions for the improvement of agricultural water rights transfer system in China. This paper studies the transfer system of agricultural water use right from the point of view of our country's national conditions, and provides a reference for the construction of socialist agricultural water right transfer system with Chinese characteristics.
