我国农业科技成果转化中的问题与法律对策研究

【摘要】：新中国成立以来,特别是近几年,中央对农业发展表现出特别的重视。农业科技成果转化不仅对科技与经济的协同与发展具有十分重要的作用,更是解决三农问题重要手段。如何更快更多的实现农业科技成果的转化是国家迫切关注热点问题。农业科技成果成功转化将直接影响科学技术和生产力的发展。在此背景下,本文以我国农业科技成果转化为基本立足点,在充分借鉴各方面研究结果的基础上,从农学的视角看待问题,基于系统论的观点和思维,综合运用农学、推广学及法学多学科的理论与方法,通过了对比分析和实证分析,并通过资金投入、中介机构、法律等方面对如何完善农业科技成果转化的问题进行了研究与探讨。本文第一部分绪论,介绍了该篇文章的选题背景和研究意义,国内外研究现状以及的研究方法。第二部分,首先对农业科技成果转化的相关概念进行了界定了,阐述了本文农业科技成果和农业科技成果转化的含义,并探讨了农业科技成果转化基础理论和知识产权理论的原理。第三部分,我国农业科技成果转化现状以及问题。运用大量的数据和实例介绍了我国农业科技成果转化现状,从中分析出及农业科技成果转化所存在的问题,并对问题进行了原因分析。第四部分,国外科技成果转化的特征及对我国农业科技成果转化的启示。主要介绍了美国和日本两个发达国家科技成果转化的特征及对我国的启示。第五部分,通过对国外和国内现状分析和总结,提出了加速我国农业科技成果转化的法律对策。主要从完善我国农业科技成果相关的法律法规、加强我国对农业科技成果转化的保护力度、用法律明确政府在市场中的调控作用、促进中介机构的发展和建立属于我们特色的农业科技成果转化基金与风险投资体系这五个方面阐述如何解决农业科技成果转化中存在问题的对策。第六部分,结论,重申文章的主要观点,提出主要运用法律手段,促进农业科技成果转化。
[Abstract]:Since the founding of new China, especially in recent years, the Central Committee has paid special attention to the development of agriculture. The transformation of agricultural scientific and technological achievements not only plays an important role in the cooperation and development of science and technology and economy, but also an important means to solve the problem of agriculture, rural and rural areas. How to realize the transformation of agricultural scientific and technological achievements faster and more is a hot topic for the state. The successful transformation of agricultural scientific and technological achievements will directly affect the development of science and technology and productive forces.
In this context, this paper, based on the transformation of agricultural scientific and technological achievements in China, is based on the research results of various aspects and views the problems from the perspective of agronomy. Based on the viewpoint and thinking of system theory, the theory and methods of Agronomy, extension and law are used in a comprehensive way. Capital investment, intermediaries, law and other aspects of how to improve the transformation of agricultural science and technology achievements were studied and discussed.
The first part of this paper introduces the background and significance of the topic, the current research situation at home and abroad and the research methods. The second part, firstly, defines the related concepts of the transformation of agricultural scientific and technological achievements, expounds the meaning of the transformation of agricultural scientific and technological achievements and agricultural technology achievements, and probes into the agricultural science and technology. The basic theory of fruit transformation and the principle of intellectual property theory. The third part, the current situation and problems of the transformation of agricultural scientific and technological achievements in China. The present situation of the transformation of agricultural scientific and technological achievements in China is introduced with a large number of data and examples, and the problems existing in the transformation of agricultural scientific and technological achievements are analyzed, and the reasons are analyzed. The fourth part is the analysis of the problems. The characteristics of the transformation of foreign scientific and technological achievements and the enlightenment to the transformation of agricultural scientific and technological achievements in China. The characteristics of the transformation of scientific and technological achievements in the two developed countries of the United States and Japan and the enlightenment to our country are introduced. The fifth part, through the analysis and summary of the current situation abroad and in China, puts forward the legal countermeasures to accelerate the transformation of agricultural scientific and technological achievements in China. In order to improve our country's agricultural scientific and technological achievements related laws and regulations, strengthen our country's protection of the transformation of agricultural scientific and technological achievements, use the law to clarify the government's regulatory role in the market, promote the development of intermediary institutions and establish the five aspects of the Transformation Fund and the risk investment system of agricultural scientific and technological achievements, which belong to our own characteristics The countermeasures to solve the problems in the transformation of agricultural scientific and technological achievements. The sixth part, the conclusion, reaffirms the main views of the article, and puts forward the main use of legal means to promote the transformation of agricultural scientific and technological achievements.
