退休金给付请求权困境的破解

【摘要】：退休金的给付与养老金给付并不是同一概念,因此其请求权也存在不同的性质,基于此,退休金请求权也呈现出其自身的特点,即退休金给付是具有强行法效力的公法规范的直接规定,而非取决于退休者与其单位的意愿表达和自由选择,但这并不意味着退休金给付请求权的生成没有任何条件。我们应着眼于对退休者提供更为有力的保障,摆脱仲裁前置和仲裁时效的束缚,并提供司法救助。将单位工龄置入单位退休金给付请求权的发生条件之一具有必要性和可行性,退休金给付请求权的标准和常态养老金给付请求权应从三个方面进行:一是养老保险缴费模式的变革问题——"费改税"的机制转型;二是养老保险基金安全的强化之道——忠实义务之实质化与立法型塑;三是养老保险基金安全性司法保障途径之拓展——公益诉讼机制的引入。
[Abstract]:The pension payment is not the same concept as the pension payment, so its claim right also has its different nature. Based on this, the pension claim right also presents its own characteristics. That is, pension payment is a direct stipulation of the public law norm with jus cogens effect, not dependent on the will expression and free choice of the retirees and their units, but it does not mean that there are no conditions for the generation of the right to claim pension benefits. We should focus on providing more effective protection for retirees, getting rid of the restraints of arbitration preposition and statute of limitations, and providing judicial aid. It is necessary and feasible to place the unit years of service in one of the conditions under which the right of claim for pension benefits is claimed. The standard of the right to claim for pension payment and the right to claim for normal pension payment should be carried out from three aspects: first, the reform of the mode of contribution of old-age insurance-the transformation of the mechanism of "fee to tax"; The second is to strengthen the security of the pension insurance fund-the essence of the loyalty obligation and the legislative model, and the third is to expand the way of the judicial protection of the security of the pension insurance fund-the introduction of the public interest litigation mechanism.
