我国电力普遍服务法律制度研究

【摘要】:随着近年来我国电力市场改革的不断推进,原有的企业内部交叉补贴模式不再适用于我国的电力普遍服务事业。电力市场原有垄断格局逐渐得以打破,新的市场竞争主体将会出现在电力市场。电力产品提供主体的转变,政府职能的转变,社会进步与经济发展的要求迫切需要建立新的电力普遍服务制度。因此,如何推进电力普遍服务制度的法律化,以及电力普遍服务具体实施手段的可行性与必要性考察成为我国电力普遍服务领域迫切需要解决的问题。本论文分为四部分。第一部分从电力普遍服务概述入手,阐述了电力普遍服务制度的概念、主体、电力普遍服务制度的法律特征等相关概念,以及我国电力普遍服务制度的理论基础等方面;第二部分通过叙述美国、日本、法国三个国家的电力普遍服务的相关立法与现实实践,着重对三个国家的电力普遍服务制度历史沿革、法律制度的构造、具体实施的方式方法进行深入分析。明确了电力普遍服务实施过程种面临的主要问题,并通过对各国立法特点和实践经验的比较,得出了对我国电力普遍服务制度立法的启示;第三部分论证了我国电力普遍服务制度的实践已经取得进展、建立立法制度的必要性以及可行性,得出我国应将电力普遍服务制度立法提上工作日程,从而完善电力普遍服务制度体系的结论;第四部分提出了构建我国电力普遍服务制度的立法建议,对其立法体系和法律制度的进行了具体设计。论文中主要运用历史分析、归纳、比较等研究方法,力求能够填补法学界对电力普遍服务制度法律保障方面研究的不足,探讨通过法律手段来构建、规范和完善我国的电力普遍服务制度。通过以上分析与研究,本文得出的结论是:我国电力普遍服务制度法律制度的建立刻不容缓,应当加快电力普遍服务制度的法律制度建设,早日使我国的电力普遍服务制度建设的全过程有法可依,有法可行,有法律保障。在我国电力普遍服务法律制度得以建立的前提下,对电力普遍服务的具体实现手段和方式进行重点分析,使我国的电力普遍服务不仅仅是以法律、制度的形式出现,更重要的是能够得以操作和实现。
[Abstract]:With the development of power market reform in China in recent years, the original internal cross-subsidization model is no longer suitable for the general service of electric power in China. The original monopoly of the electricity market is gradually broken, and the new market competition will appear in the electricity market. It is urgent to establish a new universal service system of electric power because of the transformation of the main body of electric power products, the transformation of government functions, and the demands of social progress and economic development. Therefore, how to promote the legalization of the universal service system and the feasibility and necessity of the practical means of implementing the universal service have become an urgent problem to be solved in the field of power universal service in China. This paper is divided into four parts. The first part begins with the summary of universal service of electric power, expounds the concept, the main body, the legal characteristics of the universal service system of electric power, and the theoretical basis of the universal service system of our country. In the second part, by describing the relevant legislation and practical practice of universal power service in the three countries of the United States, Japan and France, the author focuses on the historical evolution and legal system structure of the universal power service system in the three countries. The specific implementation of the methods and methods for in-depth analysis. This paper clarifies the main problems in the process of implementing the universal service of electric power, and through the comparison of the legislative characteristics and practical experience of various countries, draws the enlightenment to the legislation of the universal service system of our country. The third part demonstrates that the practice of the universal service system of electric power in our country has made progress, the necessity and feasibility of establishing the legislation system of the universal service system of electric power industry in our country have been proved, and it is concluded that our country should put the legislation of the universal service system in the work schedule. The fourth part puts forward the legislative suggestions to construct the universal service system of our country, and designs its legislative system and legal system. In this paper, historical analysis, induction, comparison and other research methods are mainly used to make up for the deficiency of the legal research on the universal service system of electric power in the legal circles, and to explore the legal means to construct it. Standardize and perfect the universal service system of electric power in our country. Through the above analysis and research, the conclusion of this paper is: it is urgent to establish the legal system of power universal service system in our country, and we should speed up the construction of the legal system of power universal service system. At an early date, the whole process of the construction of power universal service system in our country can be governed by law, feasible and guaranteed by law. On the premise of establishing the universal service legal system in our country, this paper focuses on the analysis of the specific means and ways of realizing the universal service of electric power, so that the universal service of electricity in our country appears not only in the form of law and system, but also in the form of law and system. More importantly, it can be operated and implemented.
