论城管执法制度的完善

【摘要】：随着改革的深入，经济的快速发展，吸引更多的人口涌入城市。这给城市的发展在带来新的活力的同时，也引发了很多新的矛盾和问题，例如，商贩占道经营、城市中乱建建筑、乱扔垃圾等，造成街道的脏乱差。这不仅干扰了城市的市民的正常生活，而且也影响了城市的良好发展环境。因此，为了确保城市的干净有序的生活和良好的城市发展环境，缓解市民们之间的关于生存权利之间的矛盾，政府必须对城市的发展进行管理。城管执法部门虽然存在着各种问题，被社会大众不解和辱。但是，，我们必须承认它存在的必要性，城市的发展离不开它的执法。本文以十八届三中全会的关于继续深化行政执法体制改革为背景，主要以聊城市的城市管理综合行政执法实践为例，对我国的城市管理行政执法的发展进程以及城市管理执法存在的正当性进行了阐述。并对城市管理执法事件中存在的问题进行了分析和研究，结合我国的城市管理经验的基础上，针对城市管理执法在实践中存在的问题进行了完善。全文共分为三个部分。第一部分对城管执法的正当性进行了阐述。包括人们对城管执法质疑和以及我从事实和理论两方面对城管执法制度存在的合理性的论证。第二部分以聊城市为例，分析了城管执法取得发展和取得的成效以及城管执法制度存在的主要问题和原因。第三部分结合我国城管执法的实际情况，借鉴国外的城市管理的经验，围绕城市管理执法体制的完善、健全城管执法的监督体系、完善执法部门与媒体的沟通以及妥善处理执法部门和市民的关系进行了论述。
[Abstract]:With the deepening of the reform and the rapid development of the economy, more people are attracted to the city. This brings new vitality to the development of the city, while it also causes a lot of new contradictions and problems, for example, the peddlers are engaged in the operation, the construction of the city is built, the garbage is thrown into the streets, which not only disturbs the city's citizens. In order to ensure a clean and orderly life of the city and a good environment for the development of the city, and to alleviate the contradictions between the citizens' right to live, the government must manage the development of the city. We must admit the necessity of its existence. The development of the city cannot be separated from its enforcement.
With the background of deepening the reform of the administrative law enforcement system in the third Plenary Session of the 18th CPC Central Committee, this paper mainly takes the practice of the comprehensive administrative law enforcement of urban management in Liaocheng as an example, and expounds the development process of administrative law enforcement in urban management and the legitimacy of the law enforcement of urban management in our country, and it also exists in the law enforcement events of urban management. The problem is analyzed and studied. On the basis of the experience of urban management in China, the problems existing in the practice of urban management law enforcement are perfected. The full text is divided into three parts.
The first part expounds the legitimacy of the law enforcement of urban management, including the question about the law enforcement of urban management and the reasonableness of the existence of the law enforcement system of urban management from the two sides of the facts and theories.
The second part takes Liaocheng as an example to analyze the development and achievements of urban management law enforcement and the main problems and reasons of urban management law enforcement system.
The third part, combining the actual situation of the city management law enforcement in our country, drawing on the experience of the city management in foreign countries, surrounding the perfection of the law enforcement system of urban management, perfecting the supervision system of the law enforcement of urban management, perfecting the communication between the law enforcement department and the media, and properly dealing with the relationship between the law enforcement department and the citizens.
