集体土地征收补偿制度的探讨

【摘要】：现阶段,我国社会处于转型期,城市化进程加速。一方面,城市的发展离不开土地的支持。另一方面,国家所有的土地资源有限。因而,目前的建设用地供应来源是将城市周围的集体土地征收为国有土地,进行公益事业的建设开发,土地征收问题日益成为我国城镇化建设中的首要问题。在改善集体土地征收补偿制度中,即使我国大多数学者取得了一定的成绩,但仍远远不够。现今,国内没有关于集体土地征收补偿制度的专属法律,或于《土地管理法》中设立一个专门章节来制定其补偿标准或程序,相关立法已落后于社会实践的需要。有关集体土地征收的补偿原则、范围、标准、方式等在现有的部分法律规定中还很不完善,由该问题所衍生出来的腐败现象依然存在。所以有必要改善集体土地征收补偿制度、推动补偿条例的制定、防止腐败滋生,有效缓解国内的征地问题。本文以我国集体土地征收补偿制度为导向,以征地补偿过程中留存的问题为主线,文章贯通的是怎样对集体土地征收补偿制度加以改善,合理维护农民权利的价值理念。
[Abstract]:At present, our society is in the transition period, the urbanization process accelerates. On the one hand, urban development can not be separated from the support of land. On the other hand, state-owned land resources are limited. Therefore, the current source of construction land supply is to expropriate the collective land around the city as state-owned land and to carry out the construction and development of public welfare undertakings. The issue of land expropriation has increasingly become the most important issue in the construction of urbanization in China. In improving the compensation system of collective land expropriation, even though most scholars in our country have made some achievements, it is still far from enough. At present, there is no special law on collective land expropriation and compensation system in China, or a special section is set up in the Land Management Law to formulate its compensation standard or procedure, and the relevant legislation has fallen behind the need of social practice. The compensation principles, scope, standards and methods of collective land expropriation are still imperfect in some existing laws and regulations, and the corruption arising from this problem still exists. Therefore, it is necessary to improve the compensation system of collective land expropriation, promote the formulation of compensation regulations, prevent corruption, and effectively alleviate the land expropriation problem in China. Based on the compensation system of collective land expropriation in our country and the problems existing in the process of land requisition compensation, this article is about how to improve the compensation system of collective land expropriation and how to maintain the value idea of farmers' rights reasonably.
